The new proposed boundaries, and the 29 -foot Authorized Minimum Clearance for AR -360 Topsail Reef, currently shows no potential conflicts with any charted features. We ask that NCDCM, and the USACE, please always include bounding coordinates and Authorized Minimum Clearances for Artificial Reefs /Fish Havens within Public Notices and Permits. However, I believe the latitudinal coordinate should be 34° 21.017 "N * Furthermore, the Marine Chart Division of NOAA requires 1) bounding coordinates (NAD 83) (or a center -point coordinate with radius for circular shaped reefs), along with an 2) Authorized Minimum Clearance to be included within the USACE Permit. The CAMA application did not seem to have bounding coordinates. If we can be supplied with official bounding coordinates for the AR -330 Reef, we can compare the actual proposed location/expansion with the current edition of the charts in this location before AR -330 is permitted by the USACE (This is highly recommended to prevent a permit modification in the future if there are issues with coordinates and /or location in regards to other charted features). Also, there is a clearance of 29' shown in the diagram on page 27 of the NCDMF AR Application.pdf...is 29' MLLW the official Authorized Minimum Clearance that will be provided within the USACE Permit? S mith@us ace. army. mil> wrote: Classification: UNCLASSIFIED Caveats: NONE Pursuant to the CAMA -Corps Programmatic Permit process, the North Carolina Division of Coastal Management ( NCDCM) has forwarded to our office a copy of a permit application, Field Investigation Report and Bio Report for the subject project. The attached notice requests federal agency comments on this project by June 20, 2014. The applicant proposes to expand an existing artificial reef in the Atlantic Ocean, approximately 3 miles off of the coast of Pender County, North Carolina. The expansion would involve the placement of 150 "Eternal Reef Balls" (Ultra, Bay and Pallett) into a 1.68 acre area. "Eternal Reef Balls" contain a container of cremated ashes encapsulated in concrete. The total size of the artificial reef is approximately 178 acres. The water depths in the reef area are 40 - 45' below sea level. The average footprint of all reef balls will total approximately 2,317 square feet. Please see the attached plans and the Field Investigation Report for more detailed information concerning the structures and the project. A copy of the applicant's permit application and plans is attached. Also attached is a Google Earth file (kmz) and an image Opg) file of the project area. This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson- Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The water depths in the location of the artificial reef expansion area are 40 -45' below sea level. The project area contains approximately 24 acres of natural hard bottom and the reef balls will not be deployed within 200 feet of the hard bottom areas. The project is expected to enhance fisheries. The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project will not affect any species listed as threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area.
