Dear Mr. Andrew Moore,
On March 30, 2022, Anchor QEA of North Carolina, PLLC (Anchor QEA) submitted a pre -construction
notification (PCN) on behalf of Givens Highland Farms, LLC (GHF) for the above -referenced project
for proposed work including a culvert installation and sewer -line crossing, under Nationwide Permit
(NWP) 29. One copy of the PCN was also submitted via the electronic ePCN form to the North
Carolina Department of Environmental Quality, Division of Water Resources, as required by Water
Quality General Certification No. (GC) 4256.
In supplication to the PCN, please find the responses to your request for additional information (RAI)
terms, as received by Anchor QEA on April 25, 2022 (Attachment A). Your RAI was supplemented by a
May 2, 2022, email from Amanda (Fuemmeler) Jones of United States Army Corps of Engineers with
an additional request (Attachment B). On behalf of GHF, Anchor QEA provides the following
responses.
DWR Comments Received April 25, 2022:
1. Please provide an agent authorization form from Givens Highland Farms, LLC granting you

2. Please provide a map that delineates the boundaries of the land proposed to be utilized by the
applicant in carrying out the activity; the location, dimensions, and type of any structures
erected or to be erected on the lands for use in connection with the activity; and the location
and extent of the receiving waters, including wetlands within the boundaries of the lands. [15A
NCAC 02H .0502(a)(9)]
Response on Behalf of GHF:
Please see the included civil construction site plans, with callouts to the above -referenced
locations and areas. The boundaries of land to be utilized and receiving waters are shown on the
title page Sheet G1.0, the location of impact for the sewer line is shown on Sheets C2.0 and C7.0,
and the location of impact for the culvert is shown on Sheets C2.0 and C5.0. There are no
wetlands on site and the receiving waters are: an unnamed tributary to the Swannanoa River,
North Fork Swannanoa River, and the Swannanoa River.
3. All work in or adjacent to streams shall be conducted so that the flowing stream does not come
in contact with the disturbed area. Therefore, dewatering methods will be necessary to
temporarily dewater the stream channel during culvert and sewer line installation. Please
provide a construction sequence that details the method of dewatering to be utilized at the site
and the sequence of construction events to be followed to ensure compliance with this
condition. [15A NCAC 02H .0506(b)(3)]
Response on Behalf of GHF:
A dewatering construction sequence has been added to G2.1. and a detail has been included in
Civil Site Sheet C5.3 as detail 3. A note has been added to Sheet G2.0 — Sewer Utility Notes 10.
These sheets are included in the Attachment C of selected sheets. Please refer to the redlines on
the included sheet set.
4. Please provide a stream restoration detail for proposed temporary stream impact S2. [15A NCAC
02H .0506(b)(3)]
Response on Behalf of GHF:
Typical trench backfill and stream restoration detail for the impact activities is shown as details 1
and 2 in Civil Site Sheet C7.3 and is included in the Attachment B of Selected Sheets. This activity
is also described in the construction sequence on Sheet G2.1. Please refer to the redlines on the
included sheet set.

USACE Comment Received May 2, 2022:
The application we have does not include any plans showing the proposed impacts which
should be included as well.

on the title page Sheet G1.0, the location of impact for the sewer line is shown on Sheets C2.0
