The Notice of Violation (NOV-2006-PC-0469) has been resolved. The cause of noncompliance
was an illegal discharge from a wastewater recycle pond into a storm water discharge pond. The connecting
basin has been filled. The waters in the wastewater pond are being monitored and maintained below the new
emergency level overflow. A copy of the violation letter is included. If you have any questions, please

Dear Mr. Powell:
Enclosed please find a copy of the Inspection Report from the inspection conducted on October 16, 2006. Ed
Williams of the Asheville Regional Office conducted the inspection and found the treatment facility to be in
violation of Permit WQ0015487 for the following:
Compliance Issue
Illegal discharge to waters of the State
Please refer to the enclosed Inspection Report for any additional observation and comments.
To prevent further action, carefully review this violation and respond in writing to this office within fifteen
(15) working days of receipt of this letter. You should address the causes of noncompliance and all actions
taken to prevent the recurrence of similar situations. Please be advised that this Notice does not prevent
the Division of Water Quality from taking enforcement actions for this violation or any past or future
violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more
than $25,000.00 per day per violation. If you should have any questions, please do not hesitate to contact

Reason for Visit: Routine
Inspection Summary:
The recycle permit which expired 9/30/2003 was for a 360,000 gallon capacity recirculation pond which is used to store
and recirculate used washwater from the "wet decking" log deck. There is a second pond below the recirculation pond
that is designed to hold and treat stormwater from the part of the log mill site that is separate from the wet decking area.
This second pond is permitted under DWQ's stormwater program.
At the time of the inspection, recycle water from the upper pond was overflowing into the stormwater pond, then being
discharged through the stormwater pond to the waters of the state.
The upper, recycle pond should not discharge to the stormwater pond. Two feet of freeboard should be maintained at all
times.
