Dear Mr. Powell,
On August 16, 2018, the Division of Water Resource’s Asheville Regional Office (DWR ARO)
received an Industrial Wastewater Closure Plan from your consultant Martin & Slagle
Geosciences, PA. The closure plan is a requirement for the recession of your Closed-Loop
Recycle System Permit (WQ0015487).
According to the closure plan, a temporary bypass will be installed to reroute stormwater
around the wastewater recycle pond so that impounded wastewater and residual sediments
can be tested, evaluated, and removed. The temporary bypass will discharge to a 0.3-acre
stromwater retention pond referred to as the lower pond. An outfall will be installed on the
lower pond to allow for the discharge of stormwater to Jonathan Creek. During closure
proceedings, quarterly stormwater samples will be collected at the lower pond outfall and
reported to DWR ARO and the Division of Energy, Mineral and Land Resources (DEMLR).
Once the temporary bypass and stormwater outfall are in place, impounded water in the
wastewater recycle pond will be tested, evaluated, and removed. Once the pond is dewatered,
a composite sediment and a composite soil sample will be collected from the bottom of the
pond to evaluate the underlying materials for removal. DWR ARO will begin the process of
rescinding the Closed-Loop Recycle Permit (WQ0015487) after the final closure report has been
submitted and approved.

The DWR ARO will be working closely with the DEMLR Stormwater Program to ensure a
seamless transition from a non-discharge wastewater pond to permitted stormwater retention
basin. You are encouraged to develop and implement site-specific Best Management Practices
(BMP’s) aimed at improving the overall quality of your stormwater discharge.
DWR ARO approves the Industrial Wastewater Closure Plan apart from the added requirements
and notifications provided in the bulleted items below:
DWR ARO and DEMLR ARO will conduct a joint site inspection upon completion of the
temporary bypass and the lower pond outfall. Please provide notification once these
components are in place.
DWR ARO would like to split samples during the sediment/soil assessment phase. Please
provide sufficient notification prior to sampling.
DWR ARO may conduct additional site inspections and/or stormwater sampling during
the closure proceedings.
Powell Lumber will be required to remove the temporary bypass at the end of the
closure proceedings.
Powell Lumber will be required to install a stormwater outfall on the wastewater recycle
pond before the Closed-Loop Recycle Permit (WQ0015487) can be rescinded.
