Hey Michael: Its been a while, I hope you're well.
I've reviewed the above referenced project and it looks pretty solid; thanks for that. I'd generally ask about retaining
walls to minimize impacts, but the proposed spur seems to preclude that option.
I've got a couple questions to help me complete the verification to utilize NWP 39.
1) All impacts are lumped into single 'fill' categories. Please break the impacts down into structure fill and railroad
fill. I may stack these and issue a 39 for the structure and a 14 for the rail. The impacts have been broken
down. The revised exhibit is attached. Additionally, the impact table from the PCN has been revised and is
attached.
2) A portion of the spur would be constructed off -site. Please confirm there are no potential waters to be
impacted outside what was reviewed during the PJD. There are no surface waters or wetlands located off -site in
the area where the spur is proposed to be located.

3) What dates were you on -site? I've found it eases the USFWS reviews for Schweinitz's sunflower if biologists
were there during the flowering window. I'd also like to include some verbiage about the extension from the
existing tracks (off -site). Can you provide some language for me to use? We were on -site on November 1, 2021
and November 30, 2021 (accompanied by Jean Gibby and Sue Homewood. The portion of the railroad track to
be constructed off -site contains existing gravel and rip rap that is part of the railroad bed, a narrow strip of
densely vegetated tree saplings and a sliver of a mowed field. The railroad is regularly maintained through
spraying herbicides. We did not observe habitat for Schweinitz's sunflower.
