JAY ZIMMERMAN Director This letter is to advise you that this office is considering enforcement action regarding the violations cited in the Notice of Violation (NOV) dated June 28, 2016, previously sent to you. We have reviewed the NOV response and do not feel that your response to corrective action item #2 (identify the nature of the hydraulic connection between the stormwater pond and Jonathan Creek) was sufficient. You indicated that representatives of Powell Industries have made extensive investigations of any possible connection between Pond #2 and Jonathan Creek. However, the investigations were not detailed in the response. If you wish to present an explanation for the violations cited, or if you believe there are other factors which should be considered, please send such information to me in writing within ten (10) days following receipt of this letter. Your response will be reviewed, and taken into consideration prior to assessment of any civil penalty.
