Dunn,Coastal Coordinator Habitat Conservation Division DATE: June 15,2022 SUBJECT: CAMA Dredge/Fill Permit Application for Masonboro Harbour Homeowners Association,New Hanover County,North Carolina. Biologists with the North Carolina Wildlife Resources Commission(NCWRC)reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at the end of Masonboro Harbour Road adjacent to Myrtle Grove Sound in Wilmington,NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128),as amended, Sections 401 and 404 of the Clean Water Act,as amended,the Endangered Species Act of 1973, as amended(16 U.S.C. 1531 et seq,),the Fish and Wildlife Coordination Act(48 Stat.401,as amended; 16 U.S.C. 661 et seq.),the Magnuson-Stevens Fishery Conservation and Management Act(FCMA),as amended(16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act(16 U.S.C. 703-712 et seq.). The applicant proposes to conduct maintenance dredge activities within a previously permitted and excavated basin,canal,and access channel for the community dock. The 425' by 30' access channel, 595' by 20' canal,and 265' by 190' basin will be dredged to-5' NLW. This is the same dredge footprint as the previously permitted areas,though final depths have been reduced from-6'NLW to-5' NLW due to connecting water depths. Spoils generated from the project are to be desired to be placed the Shore Acres Disposal Island at Shinn Creek,but no allowance has been received at this time. Myrtle Grove Sound at this location is classified SA-ORW and is designated a primary nursery area(PNA)by the NC Division of Marine Fisheries(NCDMF). The NCWRC has reviewed the project proposal and does not object to permit issuance since this is a previously permitted and maintained area within a PNA.PNAs are defined as those areas inhabited by the Mailing Address: Habitat Conservation • 1721 Mail Service Center - Raleigh, NC 27 699-1 72 1 Telephone: (919) 707-0220 • Fax: (919)707-0028 Page 2 embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical,chemical or biological factors.As a designated PNA,the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. Therefore,to minimize impacts to aquatic resources,an April 1 —September 30 in-water work moratorium is requested as a permit condition. The NCWRC also supports comments and recommendations from the NCDMI{to protect marine resources. We appreciate the opportunity to review and comment on this permit application.
