Thank you for your PCN, dated 4/27/2022, for the above referenced project. I have reviewed the information and need
clarification before proceeding with verifying the use of Regional General Permit (RGP) 50 (https://saw-
reg.usace.army.mil/RGP/RGP50.pdf). Please submit the requested information below (via e‐mail is fine) within 30 days
of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your
application withdrawn and close the file:
1) NCDOT currently proposes no compensatory mitigation for this project. To enable my evaluation, please confirm
whether or not any of the proposed hand clearing of forested wetlands at Sites 2, 4, and/or 5 would be
permanently maintained as herbaceous wetlands following construction (whether due to relocation of utilities
or some other reason). If such activities are proposed, please provide a compensatory mitigation plan to account
for the proposed permanent wetland fill and permanent conversion of forested to herbaceous wetlands. Note
that, unless otherwise justified based on a functional assessment (i.e. NCWAM), appropriate compensatory
mitigation ratios are 2:1 for permanent wetland fill and 1:1 for permanent conversion of forested to herbaceous
wetlands. Note also that a statement of availability letter would also be required for your proposed mitigation
provider. I spoke with the Project Bridge Engineer and was informed that hand clearing of any forested wetlands

at Site 2, 4 or 5 would not be permanently maintained as herbaceous wetlands and those areas would be
allowed to transition back to a forested wetland state.
2) Please provide the “T & E survey performed by consultants” referenced in your PCN; See attached documents.
3) At Site 6, the Corps is concerned that proposed toe protection extending through and downslope of the
proposed permanent impact to Stream A may redirect flow away from the continuation of Stream A and instead
into the toe-protected swale along the edge of the roadway. Please provide additional information to
ensure/justify that the flow within the downstream portion of Stream A would be maintained. I was informed by
the Project Bridge Engineer that at the intersection of where Stream A and the toe protection meets (reference
Station Number L-19+ 50 +/-), the stream elevation is lower than the toe protection and therefore water should
not redirect away from the stream. The toe protection detail is described in Detail #3 on the Permit Drawings.
