Dear Mr. Fulcher:
This letter is in reference to your permit renewal request received September 17, 2021.
In a letter dated April 21, 2022, Lauren Raup-Plummer of the Water Quality Permitting Section's
Non -Discharge Branch asked you to provide additional information (copy of letter attached) no later than
the close of business on May 23, 2022. As of today, this information has not been received, therefore, the
Division of Water Resources must return your application as incomplete in accordance with 15A NCAC
02T .0107(e)(2).
Please be advised that operation of the subject facilities without a valid permit is a violation
of G.S. 143-215.1, and may subject you to appropriate enforcement actions pursuant to G.S. 143-
215.6A., 6B., and 6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure
to secure a valid permit.
Therefore, it is imperative that the requested additional information and associated renewal
application be submitted within 30 days of receipt of this letter. Failure to provide the requested additional
information and the associated renewal application shall result in a Notice of Violation and may include a
civil penalty assessment.

additional information is required before the review may be completed. Please address the item on the

A. Existing Permit:
During communications with Mr. Don O'Mara regarding the now -resolved air mixing question, it
was determined that the ultraviolet (UV) disinfection system was modified from the permitted two
62 gallon per minute (GPM) disinfection units to three 40 GPM UV disinfection units. This change
is a minor modification, and the Non -Discharge Branch does not have any records of this
modification being submitted for review. Please provide information regarding the UV disinfection
system including equipment type, treatment configuration, calculations, operation and maintenance
requirements. Please also provide information for any additional or modified piping or
appurtenances that were required for installation of the modified system. Please submit application
form HRIS 06-16, signed and sealed engineering documents pursuant to 15A NCAC 02T .0704.
Our understanding is that this equipment has already been installed, as such please also provide the
date it was installed, an executed engineering certification, and the updated Operation and
Maintenance (O&M) plan.
