Attached is a complete Application for Standard Department of Army Permit (Individual Permit)
and supporting documents for the proposed realignment of Herbert Akins Road in Fuquay -Varina
(Wake County). The project site is located immediately east of the intersection of Herbert Akins
Road and Belvinwood Drive. All proposed wetlands, stream, and buffer impacts required for the
project are contained within the boundaries of a single 3.08 acre parcel that is bound to the north
and east by existing Herbert Akins Road (PIN 0668035881). Mitchell Environmental, PA is the
Authorized Agent for this project, as illustrated on the attached Agent Authorization Form signed
by Mr. Adam Mitchell, Town Manager of the Town of Fuquay -Varina on March 20, 2014. This
project will be constructed concurrent with construction of infrastructure for Sunset Bluffs
Subdivision.
Long Range Transportation Plans
The road will be realigned as illustrated on the CAMPO 2035 Long Range Transportation Plan,
as part of a future thoroughfare connection between NC 55 to the west and US 401 to the east
(road segment A303 on CAMPO plan; http:!/www.campo-nc.us/Maps12035-
LRTP /Amended Highway_Map_CAMPO_DCHCV]Extent -2011- 03- 16_36x24.pdj). Wake
County GIS maps illustrating the future connection between NC 55 and US 401 are attached.
Ultimately, this thoroughfare is planned to provide a four lane divided section from NC 55 to US
401, but only two travel lanes are proposed under the current proposal. Town of Fuquay -Varina
staff anticipate a 20 year timeframe for completion of the full four lane thoroughfare, as dictated
by traffic needs. The road realignment illustrated on the attached impact maps was presented to
Mr. Jamie Schern approximately five to six years ago, and Mr. Schern was supportive of the
alignment at that time.
Proposed Wetlands. Stream, and Buffer Impacts
Proposed permanent wetlands, stream, and buffer impacts required for the construction of the
road realignment are detailed in Table I below, and illustrated on attached impact maps.

The wetlands delineation for this site was verbally approved by Mr. James Lastmger on
September 27, 2013, following a field concurrence meeting with me. Neuse Riparian Buffers
were approved by Mr. Cheng Zhang of the DWR Raleigh Regional Office on July 17, 2013,
following a field stream origin determination with me. A copy of Mr. Zhang's "Surface Water
Determination Letter" is attached.
Avoidance and Minimization
The proposed realignment utilizes minimum horizontal curve criteria for the anticipated speed
limit through this area, while utilizing as much of the existing alignment as is practical and safe
per NC DOT standards. The existing horizontal curve that will be replaced has a much smaller
radius that is a clear and undisputable safety hazard for people using this road. Avoidance of
impacts for this project is impractical due to NC DOT horizontal and vertical curve design
requirements. Bridging the wetlands and stream on this site are not practical due to associated
costs. A bottomless culvert was evaluated by the design engineer, and that option was
determined to be unsuitable due to vertical separation requirements between the culvert structure,
road subgrade and utilities. Ultimately, earthen fill in combination with a single 72 inch RCP
culvert for the stream crossing was determined to be the most effective means of meeting project
goals, while also providing passage for aquatic species. The culvert invert will be buried one foot
below the stream bed to promote aggradation of stream sediments, as required by Corps and
DWR policies. Proposed impacts have been minimized by tapering the two lane divided roadway
section to an undivided two lane section prior to the stream crossing, and by designing the
crossing as perpendicular as is practical to wetlands, the stream, and buffers.
Mitigation
Wetlands mitigation requirements will be made through payment to an approved mitigation
bank(s) within the project HUC (03020201), applying a 2:1 mitigation ratio. If adequate credits
are not available through mitigation banks, the remaining amount of required mitigation will be
provided through payment to the NC EEP. Also, as discussed above, the existing Herbert Akins
Road alignment will be removed and the stream segment that is currently piped will be restored
by matching upstream and downstream cross- sections (including portions of the floodplain).
Restoration of the currently piped stream segment and its surrounding floodplain will provide
mitigation for stream and buffer impacts, although none are required per Corps policy or state
rules.
Alternatives Analysis
Multiple thoroughfare alignment options were prepared by Withers & Ravenel, PA, and presented
to Mr. Jamie Schern approximately five to six years ago, as discussed above. Per Town of
Fuquay -Varina staff, Mr. Schern was supportive of the currently proposed alignment at that time.
The proposed alignment utilizes existing infrastructure to the maximum extent practical, while
minimizing impacts to environmentally sensitive areas and single - family homes. No reasonable
alignment options exist north of the project site due to existing single - family home
neighborhoods that occupy nearly all of the land area southeast of Bass Lake. One alignment
option exists south of the project site that would have only minimal impacts to existing single -
family homes; however, this alignment would be much longer and more tortuous than the
proposed alignment due to the locations of existing single - family homes and environmentally
sensitive areas between Herbert Akins Road and James Slaughter Road. After a thorough
evaluation of available thoroughfare alignment options, it is clear the proposed realignment is the
best option available that meets current and future traffic needs, while concurrently minimizing
impacts to single - family homes and environmentally sensitive areas.
Endangered Species and Designated Critical Habitat
The US FWS Species by County Report lists four endangered species in Wake County, including:
1. Red - cockaded woodpecker;
2. Dwarf wedgemussel;
3. Michaux's sumac, and;
4. Northern Long -Eared Bat.
Telephone conversations with Mr. John Ellis and Mr. Dale Suiter of the US FWS Raleigh
Ecological Services Field Office indicate the only species of concern on this list for the project
site is Michaux's sumac. Mr. Suiter recommends a biological assessment be completed for the
project site, specifically for Michaux's sumac. We have submitted a letter and supporting
documents (GIS maps, aerial photos, impact maps, site photos, and USGS topo quad map) to Mr.
Pete Benjamin of this same Raleigh Field Office, requesting a formal Endangered Species
Consultation for the project site. We will forward a copy of their response to you upon our
receipt of that response. Additionally, we will provide you with a report of our biological
assessment observations once the field investigation is complete.
Essential Fish Habitat
This project will not occur in or near an area designated as essential fish habitat. The NOAA
Essential Fish Habitat Mapper was used for this determination.
Historic or Prehistoric Cultural Resources
This project will not impact any historic or prehistoric cultural resources. A GIS map from the
NC State Historic Preservation Office, HPOWEB GIS Service is attached as supporting
documentation.
Flood Zone Designation
This project is not located within the boundaries of a FEMA- designated 100 -year floodplain. A
GIS map generated by the NC Floodplain Mapping Program is attached as supporting
documentation.

Proposed activity is a road realignment that involves the placement of one culvert and fill in wetlands and a stream to facilitate road
construction. Existing road alignment and associated culvert and fill will be removed as part of this activity, including restoration of piped
stream channel Proposed 72 inch diameter RCP culvert and associated headwall and endwall total approximately 122 linear feet in length.
Remainder of proposed impact consists of soil fill placed to support road realignment, including required shoulders and slopes to existing
grade. Equipment used for this activity includes tracked excavators, rollers, dump trucks, paving equipment, etc.

This project is part of the CAMPO (Capital Area Metropolitan Planning Organization) 2035 Long Range Transportation Plan, amended
March 16, 2011 The existing curve in this location is dangerously sharp, and it does not meet current NCDOT highway design criteria for
the desired roadway classification The purpose of this project is to realign this section of Herbert Akins Road to meet current NCDOT
design criteria, while also contributing to the CAMPO 2035 Long Range Transportation Plan. Construction work for this project is
scheduled to begin around April 2015, with anticipated completion 6 months after start of construction.

Director An appeal request must be made within sixty (60) days of date of this letter or from the date the affected

• Results are displayed for significant natural heritage areas by default. To display results for managed areas, click the appropriate radio button in the "SHOW
RESULTS FOR" section above the results table.
• Clicking on a column name in the results table will sort all entries in that column; clicking a second time on the column name will reverse the sort.
• The results can be further refined by entering a text string in the "Filter search results" field. Entries not containing the text string will be removed from the
table of results.
• Clicking the "Download Results' button will give you the option of saving the results table to a comma- separated - values file. This type of file can be opened in
most spreadsheet programs, including Microsoft Excel.
