Below are my notes from our conversation for your bank records. BLUF: I asked them to move the fence so that it aligned with our easement line and eliminate the road within the easement. Teleconference with Wildlands: John Hutton, Jeff Keaton 07-Jun-2022 * This area is outside of the required 50' buffer and does not affect any credits directly (125 sgft or 0.00287 ac) * This property has a complicated history with a farmland preservation easement that created this situation; Triangle Land Conservancy (TLC) surveyed the Farmland Protection easement for NRCS, which is supposed to directly abut our CE, but they missed the farm road in the survey for the original plat. The fencing contractor just used the road as a guide for fence installation since the road was not on the plat. * Our CE has no allowable acceptances for farm roads. * Wildlands discovered this about a year ago, but well after the as -built. * The landowner does not want to move the road. * Wildlands is requesting an easement exemption overlay to allow the farm road to be in our CE, without amending the easement. If they had to amend the easement to eliminate the road, they would have to work with TLC to change the farmland protection easement because it must be directly adjacent to our easement. * I was firm that our preference is to move the fence to the original easement line and plant the small section where the road was. They can relocate the road. John is going to meet with the landowner and follow up soon. I'd like to set up a call with you to discuss a small issue with the easement at the Bethel Branch site. We became aware a while ago that the fencing contractor did not fence out a small part (-125 sq. ft.) of the easement as shown on the attached map. We don't mind moving the fence but it would then require the land owner to move his farm road which he does not want to do. It would be easier to give you the background and details on a call. We can invite Erin or anyone else you think is important to join in but I figured you would be the best person to start the communication with.
