Dear Cornelia Ford:
On March 31, 2021, the Director of Division of Water Resources (DWR) assessed a
civil penalty against you in the amount of $2,971.00, including $471.00 in investigative
costs, for a high lagoon level, failure to notify the Division, failure to maintain lagoon
banks.
You requested a schedule for making partial payments toward the $2,971.00 civil
penalty and DWR agreed to a payment schedule beginning on October 1, 2021 and
continuing to September 1, 2022. DWR has an agreement with you on a schedule of
Eleven (11) payment of Two Hundred Fifty Dollars ($250.00) to be made once every
month and One payment of Two Hundred Twenty-one Dollars ($221.00). DWR
acknowledges one payment of $221.00 on October 5, 2021; and Three payments of
$250.00 on November 16, December 17, 2021 and March 31, 2022. However, DWR
has not received the February 1, 2022, through June 1, 2022 payments so far. The total
balance of the penalty is $2,000.00. Payment should be made by check or money order
payable to the North Carolina Department of Environmental Quality (NCDEQ) sent to
my attention at the address below:

Due to your failure to make the monthly payments in accordance with the agreed
payment schedule the entire unpaid balance of the civil penalty is now due and payable
and subject to collection through a civil action in the superior court. North Carolina
General Statue 143-215.6A(g) allows the Secretary of the Department of Environmental

Quality to request the Attorney General to institute a civil action in Superior Court of
any county in which the violator resides or has his or its principal place of business to
recover the amount of the assessment.
Failure to submit full payment of the penalty within 10 days of receipt of this letter will
result in interest being charged from the date the penalty became due and owing. This
letter serves as final notice that the Division will proceed to refer your case to the North
Carolina Attorney General's Office unless full payment of this civil penalty is received
within 10 days of your receipt of this notice, the North Carolina Attorney General's
Office will seek collection through the courts. Should you have any questions, please
