I need a package to include our 7D request form, the updated delineation map reflecting the
changes we made, and an upland sheet.
I didn't agree to 5 acres of establishment. I believe you may have meant to type 0.5 acres ??
That established, the most northern trash pond you are proposing to restore is jurisdictional
and that is why it is not establishment but restoration. There was an area to the west where
he is currently stockpiling that you thought may need to be included in the restoration
boundary. This area is likely non - wetland; therefore, only that area would be creation and
for that area only the ratio will be 10:1. After telling you this, you stated that you may
not need to include that space because the area of the trash pond should be enough to offset
the 0.25 acre of impact at a 2:1 ratio, resulting in 0.5 acres of restoration. Because this
pond is a jurisdictional feature, the filling activity will need its own permit. If you were
offsetting impacts with EEP or a bank, you wouldn't need a NWP 27 because they already have
one. Follow me? The NWP 44 does not allow for filling activities not directly associated with
mining activities.
The restoration is a different activity even though we are using that activity to offset the
mining activities. Clear as mud I'm sure.

No, not the restoration. The pond is jurisdictional so you need a permit to place fill
material in it despite the fact that the activity is being done to offset impacts under the
NWP 44. So you'll need two permits from us, but you can submit one PCN to me and include
information for both activities.
Also, I need to get an updated 7D package from you guys so I can issue the 7D and 7ennifer
can submit the variance package. I believe she needs a 7D from me saying that it is wetlands
and therefore a variance is needed.

It was a pleasure meeting you yesterday. During our conversation, you mentioned that the
proposed activity at the mine would be covered under NWP
27 (Restoration Enhancement of Aquatic Habitat). However, I believe that it would fall under
NWP 44 "Mining Activities ". Would you agree?

I've attached a field sketch with wetlands, ponds, and approximate spoil areas, as well as a
couple data sheets, and a Rapanos form. I forgot to get an upland plot when I was there

Hi Emily,
We have been retained by Scott Cayton to help him get into compliance with his current
situation at his sand mine. My coworker Dana Lutheran and I met with a group of NCDENR folks
on May 20th, to get up to speed on everything, and to try to keep him moving forward.
Everyone felt that it would be wise to have a good current delineation on the ground, since
the only thing that had been done up to that point was a sketch and some soil boring data,
and some field meetings between you, Scott Stone, and Scott Cayton. I have flagged all of the
existing wetlands on the property he is currently working on.
I need to set up a field visit with one of you. Please let me know your earliest field date,
and we'll get out there and look at flags, and discuss his options, in regards to permitting
and a possible variance with the State. I'll be forwarding you 7D materials as soon as I
complete them.
Please feel free to call me if you'd like to discuss this before we meet.
