The Town of Bryson City has the following response to the Notice of Violation letter dated June 7, 2022
for the violation on May 26, 2022,
On May 26, 2022, the area experienced flooding. In order to help the flooding situation, Duke Energy
released water from the Dam in Jackson County which in rem created flooding in multiple low-lying areas
in Swain County including Darnell Farms and Bear Hunter Campground. All manholes and clean outs in
this area were under water causing sewer lines to surcharge and the manhole at 45 Everett Street to
overflow. We have taken the following steps to address this simation:
1) We have received an additional $55,000 for Phase II of an Asset Inventory and Assessment Grant.
This funding is being used to continue a comprehensive infiltration/inflow evaluation of our
sanitary sewer collection system.
2) The Town of Bryson City has been approved for $8,780,000 through United States Department of
Agriculture to begin Phase I of a project to replace outdated and insufficient lilies to correct the
inflow and infiltration issues we are having in our system.
3) We have included money in the 2022-2023 draft budget to purchase 50 bolt down, water -tight
manhole lids.

A review has been conducted of the self -reported Sanitary Sewer Overflows (SSO's) S-Day Reports submitted by
Town of Bryson City. The Division's Asheville Regional Office concludes that the Town of Bryson City violated
Permit Condition I (2) of Permit No. WQCS00170 by failing to effectively manage, maintain, and operate their
collection system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO
constituted making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is
required by G.S. 143-215.1.
The Asheville Regional Office is providing the Town of Bryson City an opportunity to provide evidence and
justification as to why the Town of Bryson City should not be assessed a civil penalty for the violation(s) that are
summarized below:
