PROJECT SUMMARY: The applicant proposes to add a new 10'by 16'floating dock to an existing docking facility fora total of 3 slips. 4 Pipers Neck, Nelson, Ryan Page Two 9. PROJECT DESCRIPTION The project site is located at 4 Pipers Neck on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County.The island is accessed from the mainland at the end of Edgewater Club Road(SR 1402),by private bridge over the Atlantic Intracoastal Waterway(AIWW)and an earthen causeway,which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 1.7 miles then turn right onto Pipers Neck Rd. Keep to the right and the project site will be on the left. The 0.42 acre property is located on the south end of Figure Eight Island, adjacent to Banks Channel and Middle Sound. The parcel has an existing single family residence, with a bulkhead, docking facility, with the highground approximately 5' above normal high water(NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The approximately 92 linear feet of shoreline frontage along Banks Channel is currently stabilized by a bulkhead that is just above NHW. No coastal wetlands were noted waterward of the bulkhead by DCM during the May 3, 2022 site visit. The applicant currently maintains an existing private docking facility.A fixed pier extends northwest from the bulkhead into the man-made bay, measuring approximately 40' in length by 6' in width, terminating in a 8' by 16' T-head platform. An access ramp extends from the platform onto a floating dock, positioned perpendicular to the bulkhead, measuring approximately 20' in length by 8' in width. A boatlift, measuring approximately 14' by 15' is located on the northern side of the floating dock. The boat lift was originally authorized via CAMA General Permit No. 27378D issued to a previous owner on 4/17/01. Permit history was not found for the bulkhead. CAMA General Permit No. 69046D was issued on 3/24/17 for replacement of the existing docking facility. The existing docking facility currently accommodates up to two(2)vessels. The Wilmington-New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of this canal, Banks Channel, and Middle Sound are classified SA•ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to add a new 10'by 16'floating dock to an existing docking faiclity for a total of 3 slips. The proposed 10' by 16'floating dock would be added the waterward end on the southern side of the existing floating dock, parallel to the shoreline. With the proposed addition, the floating dock would have an L-shaped configuration with water depths approximately-2-3.5' at normal low water (NLW). The proposed float would extend to within approximately 1' of the 15' riparian setback. A waiver was obtained from the neighboring property owners on the south side since float would be close to the setback(see Drawing 1 of 3). Water depths are-2 ft.at normal low water(NLW)on the landward side of the proposed floating dock. The docking facility adheres to the 8 square-foot rule and extends approximately 80' into the approximately 380'wide waterbody. 10. ANTICIPATED IMPACTS As proposed,the new floating dock would result in the incorporation of approximately 160 ft2 of additional Public Trust Area and Estuarine Waters. The project area consists of open water, and there would be no impact to vegetated wetlands or to the high ground area. No encroachment of the15' riparian set back is anticipated; however,the proposed structure would be within 1' of the setback so a waiver from the adjacent neighbor was obtained. No encroachment over the pier headline is anticipated. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction.
