9. PROJECT DESCRIPTION
The project site is located at 4 Pipers Neck on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New
Hanover County.The island is accessed from the mainland at the end of Edgewater Club Road(SR 1402),by private bridge
over the Atlantic Intracoastal Waterway(AIWW)and an earthen causeway,which traverses Middle Sound. Heading east on
the causeway, turn right on Beach Road South and travel south approximately 1.7 miles then turn right onto Pipers Neck
Rd. Keep to the right and the project site will be on the left.
The 0.42 acre property is located on the south end of Figure Eight Island, adjacent to Banks Channel and Middle Sound.
The parcel has an existing single family residence, with a bulkhead, docking facility, with the highground approximately 5'
above normal high water(NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn
grasses. The approximately 92 linear feet of shoreline frontage along Banks Channel is currently stabilized by a bulkhead
that is just above NHW. No coastal wetlands were noted waterward of the bulkhead by DCM during the May 3, 2022 site
visit.
The applicant currently maintains an existing private docking facility.A fixed pier extends northwest from the bulkhead into
the man-made bay, measuring approximately 40' in length by 6' in width, terminating in a 8' by 16' T-head platform. An
access ramp extends from the platform onto a floating dock, positioned perpendicular to the bulkhead, measuring
approximately 20' in length by 8' in width. A boatlift, measuring approximately 14' by 15' is located on the northern side of
the floating dock. The boat lift was originally authorized via CAMA General Permit No. 27378D issued to a previous owner
on 4/17/01. Permit history was not found for the bulkhead. CAMA General Permit No. 69046D was issued on 3/24/17 for
replacement of the existing docking facility. The existing docking facility currently accommodates up to two(2)vessels.
The Wilmington-New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property
as Conservation. The waters of this canal, Banks Channel, and Middle Sound are classified SA•ORW by the Division of
Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and
they are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to add a new 10'by 16'floating dock to an existing docking faiclity for a total of 3 slips. The proposed
10' by 16'floating dock would be added the waterward end on the southern side of the existing floating dock, parallel to the
shoreline. With the proposed addition, the floating dock would have an L-shaped configuration with water depths
approximately-2-3.5' at normal low water (NLW). The proposed float would extend to within approximately 1' of the 15'
riparian setback. A waiver was obtained from the neighboring property owners on the south side since float would be close
to the setback(see Drawing 1 of 3). Water depths are-2 ft.at normal low water(NLW)on the landward side of the proposed
floating dock. The docking facility adheres to the 8 square-foot rule and extends approximately 80' into the approximately
380'wide waterbody.
10. ANTICIPATED IMPACTS
As proposed,the new floating dock would result in the incorporation of approximately 160 ft2 of additional Public Trust
Area and Estuarine Waters. The project area consists of open water, and there would be no impact to vegetated wetlands
or to the high ground area. No encroachment of the15' riparian set back is anticipated; however,the proposed structure
would be within 1' of the setback so a waiver from the adjacent neighbor was obtained. No encroachment over the pier
headline is anticipated. There appear to be no SAV present in the project area. Minor increases in turbidity should be
expected during project construction.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Ryan
Nelson,for State approval for development of the subject property located at 4 Pipers Neck, adjacent to Banks
Channel, on Figure 8 Island, New Hanover County. It was received as complete on May 22, 2022 and appears to be
adequate for processing at this time. The projected deadline for making a decision is August 5, 2022.An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances,this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 22,2022, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner,developer, and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by NCGS
113A-119(b) that the following applications were submitted for a development permits in Areas of
Environmental Concern as designated under the CAMA: On June 8, 2022, the NC Dept. of Natural
& Cultural Resources proposes the restoration of existing earthwork fortifications to construct a
new visitor center w/expanded parking lot& to construct a new underwater archeology building
at 1610 Fort Fisher Blvd., adj. to the Atlantic Ocean in Kure Beach, New Hanover County; On
June 8, 2022, Ryan Nelson proposed to add a new 10'x 16'floating dock to an existing facility for
a total of three (3) slips at 4 Pipers Neck, adj. to Banks Channel on Figure 8 Island, Wilmington,
New Hanover County;And on June 8, 2022, Susan Lamy proposed to install a boatlift for a total
of three (3) slips at an existing two (2) slip facility at 9 Bermuda Dr., adj. to Lee's Cut in
Wrightsville Beach, New Hanover County. Copies of these applications can be examined or copied

Background
On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the
Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of
the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect.
The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401
Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must
request a pre-filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R.
§121.4] In turn, the Federal Rule requires that applicants include documentation of their pre-filing meeting
request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to the Federal
Rule for more information.
Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre-filing
meeting request documentation does not constitute a "certification request." As a result of the reinstatement
of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022 that do not have
documentation that a pre-filing meeting request was submitted at least 30 days prior to submittal of a 401
Certification application will be returned as incomplete.
