Note: The property within the Cate's Creek Parkway right of way has changed ownership
since the 2013 approvals. The right of way property is now owned by SLF II NC-
Waterstone, LLC. Deeds are attached.
The project has not changed from that permitted in 2013, with the exception of this request for a
minor change to Impact 42. The applicant is proposing to complete Cates Creek Parkway which
was approved in 2006 and again in 2013 by both the USACE and NC DWR. Cates Creek
Parkway is a requirement of the Town of Hillsborough to provide an alternate access to the
Waterstone develpment as well as providing a connection to Old NC 86 (aka Churton Street).

Due to the economic crisis which slowed development considerably, this project was also delayed
and therefore, only half of Cates Creek Parkway was built as of 2013. The applicant is now in a
position where not only can this roadway be completed, but also the Town of Hillsborough is
pushing to see it finished. The permits were renewed in 2013 and construction began earlier this
year. All impacts are complete or under construction, with the exception of Impact 42 (discussed
in more detail below). Impact 91, the bridge crossing of Cates Creek, has been cleared, graded,
including the filling of the permitted wetlands, the headwalls and footers for the bridge are almost
complete.
PERMITTED IMPACTS & REQUESTED MODIFICATIONS
The tables below include the Impact #2 impacts permitted in 2013 and requested modifications.
Detailed onsite construction survey discovered an error in the design plans which resulted in the
need for modifications to the design. These modifications require 20 additional feet of permanent
impacts and I foot less of temporary impacts. Basically the pipe needed to be extended 14 feet
on the north side and 6 ft on the south side, pushing the rock dissipater further downstream to the
north. The permanent impacts (both previously permitted and under this modification request)
include not only the pipe, but also the rock dissipater. The engineer has redesigned the dissipater
to be located at the existing stream bed elevation and shaped to allow a defined low flow
channel /swale through the dissipater that transitions to the existing stream alignment, to prevent
over - widening of the stream bed and promote as close to natural channel bed formation post -
construction as possible, while still providing the required energy dissipation during high flows.
This is consistent with previous restoration efforts performed elsewhere within the Waterstone
development and approved by the USACE and DWR. We understand that the USAGE no longer
considers such a dissipater design as requiring mitigation. Low and high flow pipes have also
been incorporated into the design.
The 68 feet of temporary impacts are for E &S measures (e.g., pump around) so that the culvert
installation will occur in the dry. Once the culverts have been installed and the area stabilized,
the impervious dikes, check dams and pumps will be removed and the stream flow will be
returned through the culverts. These temporary impacts will be completely removed in the
upstream (south) end and converted to the dissipater in the downstream (north) end.

MITIGATION
As discussed the mitigation was previously satisfied and no additional mitigation should be
required. The impacts at this crossing are less than 150 feet. Also, the overall Waterstone
development was permitted for 292 LF of permanent impact to perennial streams back in 2006

(including the permanent impacts for Impact #2). These stream impacts were mitigated for at a
2:1 ratio (584 ft.; EEP receipt provided in 2013 application) As such the DWR mitigation
requirements have been met No additional mitigation should be regwred, for the impacts
requested' in this modification, given the redesign of'the}dissipater which under current USACE
policy would not require mitigation, even though it was previously mitigated for already
STORMWATER / DIFFUSE FLOW
There.has been no change to the level spreader designs previously approved The amount of
buffer impacts for the level spreader bypass channel have been reduced The Town of
Hillsborough.is delegated the Neuse'Buffer Rules and have previously approved these impacts.
The total buffer impacts have been slightly reduced (12 sf less).
