Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The following changes were made to the second draft permit sent to you on April 19, 2022: • The permit expiration date was extended to June 30, 2027 to better cover the five-year permit term. Accordingly, the three years to sample for Effluent Pollutant Scan have been adjusted to 2024, 2025, and 2026. • The system component list in the Supplement to Cover Sheet has been updated to reflect plant upgrades communicated by the Permittee. • The effective date for effluent Conductivity monitoring has been delayed six months to allow the Permittee to acquire equipment and lab certification [See A. (1.)]. • Instream Conductivity monitoring was added to the permit in agreement with the Fact Sheet, based on 15A NCAC 02B .0500 [See A. (1.) and A. (2.)]. • Footnotes in the Instream Monitoring section have been modified to clarify the waiver as member of monitoring coalition for all parameters except Hardness. [See A. (3.)]. Attached is a listing of comments received and Division responses in the form of a Fact Sheet Addendum. The following changes were made to the draft permit sent to you on April 8, 2020 as a second draft permit sent to you on April 19, 2022: • A special condition to monitor PFAS chemicals 2/year has been added to the permit, to be effective six (6) months after EPA has a final wastewater method in 40 CFR 136 published in the Federal Register [See A. (1.) and A. (2.)]. • Based on 15A NCAC 2B .0500 — Surface Water Monitoring: Reporting, and that the facility receives industrial discharges via a pretreatment program, effluent and instream monitoring of Conductivity has been added to the permit [See A. (1.) through A. (3.)]. • The Latitude and longitudinal coordinates for the outfall have been corrected on the permit map. This final permit maintains the following significant changes identified in the letter sent on April 8, 2020: • Since the UV system and two trickling filter units are no longer in use, they have been removed from the facility components list. • Regulatory citations have been added to the permit. • Based on NPDES guidance regarding the reduction of monitoring frequencies in NPDES permits for exceptionally performing facilities, monitoring requirements for BOD5, NH3-N, and TSS have been maintained at twice per week at the 12.5 MGD flow tier [See A.(1.)]. • The NC 2007-2014 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Committee (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016 with some exceptions. The NC Division of Water Resources NPDES Permitting Unit is required to implement the new dissolved metal standards in all permits public noticed after April 6, 2016. The new standards for most metals include acute standards. Further, the freshwater standards for several metals are expressed as the dissolved form of the metals, and seven metals have hardness -dependent equations. As a result, the NPDES Permitting Unit will need site -specific effluent hardness data and instream hardness data, upstream of the discharge, for each facility monitoring these metals in order to calculate permit limitations. Effluent hardness and instream hardness sampling, upstream of the discharge, have been added to the permit at a monitoring frequency of quarterly [See A. (1.) through A. (3.)]. • Some of the wording has changed in Special Condition A. (4.), Chronic Toxicity Permit Limit, to include both 12.5 and 20.0 MGD flow tiers and to allow for electronic submittal of test results. As a result, the special condition for Chronic Toxicity Permit Limit at 20 MGD has been removed from the permit. Please review each paragraph carefully of the combined special condition carefully. • Special Condition A. (6.) has been modified to update the specific three years in which the Effluent Pollutant Scan shall be performed. In addition, some of the wording has changed to allow for electronic submittal of effluent pollutant scans and second species toxicity results. Please read each paragraph carefully. • Parameter codes have been added to the Effluent Limitations and Monitoring Requirements, Instream Monitoring Requirements, and the Effluent Pollutant Scans special conditions [See A. (1.) through A. (3.), and A. (6.)]. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The requirement to continue reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your NPDES permit [See A. (7.)]. • Based on Mercury TMDL evaluation showing mercury values reported at levels > 1 ng/L and since the permitted flow is greater than 2 MGD, wording in the Mercury Minimization Plan special condition has been changed toward plan's maintenance [See A. (9.) Nutrient Reopener for High Rock Lake has been modified to include possible nutrient criteria. • The map has been modified to show the instream sampling locations as well as the locations of Grants Creek and Towns Creek WWTTs. Pretreatment updates in response to NPDES permit renewal: • On December 28, 2022, 180 days after the effective date of this NPDES permit renewal, the Town of Ramseur is required to submit to the Division a written technical evaluation of the need to revise local limits (i.e., an updated IWS/HWA-AT/L-STMP, or documentation of why is not needed). This action may include revising, updating, or adding to the list of SIUs regardless of timeframe. o Submit the updated Short -Term Monitoring Plan (STMP) • Review pollutants of concern (POCs) and update the STMP to reflect pollutants in industrial user permits (IUPs) and sludge management permit. • The specific PFAS parameters are to be determined upon EPA publishing a final wastewater method in 40 CFR 136 in the Federal Register. o As part of the local limits assessment, please submit the updated Headworks Analysis (HWA). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. The NPDES standard conditions (Parts II, III, and IV) are the same as in your current permit except that agency and division names have been updated. The Division may require modification or revocation and reissuance of the permit. Comments were received and responded to in the form of a second draft that was sent for public comment period, notice April 21, 2022. Comments were received by DWR-Aquatic Toxicity Branch (ATB), the Permittee, and SELC. Comment from Zachary Thomas, DWR-ATB and DWR responses: Comment: The ATB contact cc'd in the cover letter needs to be updated. Response: Corrected. Comment: Please confirm that Permittee is responsible for submitting the AtC/Engineering Certificate before operating under 20 MGD requirements. Response: This is noted in the Supplement to Cover Sheet (Item 4) and in Section A. (1.)(a.). Comments from Sonja Bassinger (Permittee) and DWR responses: Comment: The City requests extension of the permit expiration date to June 30, 2027, for a five-year permit term. Response: Extension granted. Comment: The City requests changes to be made to the Grant Creek WWTT to reflect current pant upgrades. Response: Corrections made. Comment: The City requests a four -month extension of permit effective date for effluent Conductivity monitoring to allow the City to acquire equipment and certification. Response: The effective date has been delayed six months. Comment: The City requests clarification of instream monitoring parameters and the waiver of instream monitoring as a member of the monitoring coalition. Response: The parameter list was reviewed; Conductivity was added, and Fecal Coliform was confirmed it is not necessary and not added. The footnotes were revised to clarify which parameters (all but Hardness) are waived. Comment: The City requests monitoring for WET testing be reduced from quarterly to two times per year based upon (1) past compliance history and (2) low IWC. Response: WET testing is a screening test for all toxicants in the effluent, and quarterly sampling is needed to account for seasonal differences in effluent quality. Further, 15A NCAC 2B .0508 states that toxicity testing frequency will be defined as a minimum of quarterly (footnote **): "**Specific test type, conditions, and limitations will be defined by permit. Toxicity limits will be applied to all major discharges and all discharges of complex wastewater. Toxicity limitations and monitoring requirements may be applied to permits for other discharges when, in the opinion of the Director, such discharge may impair the best use of the receiving water by the discharge of toxic substances in toxic amounts. Specific frequency will be defined by individual permit conditions. Comment: The City suggests corrections to be made to the Fact Sheet: • Permitted industrial flow is 1.0518 MGD • Number of Sills is 7 • Number of effluent pollutant scans submitted is 4 Response: Corrections made. Comments from SELC and DWR responses: Comment: Recommend stating in the final documents that "The permittee has no permit shield for the discharge of PFAS compounds because no such chemicals were disclosed in the permit application or otherwise." Response: Comment noted. Comment: "DEQ must look beyond PFOA and PFOS when addressing PFAS in NPDES permitting and, at the very least, begin applying EPA's draft analytical method 1633—which EPA has already begun applying." Response: Comment noted. Currently the only regulated PFAS chemicals are PFOA and PFOS via a Health Advisory Level, and currently there is no multilaboratory-validated method yet published in the Federal Register. The current approach is appropriate. The facility shall monitor for TRC when using chlorination for disinfection. The Division shall consider all TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field -certified), even if those values fall below 50 µg/L. 7. Effluent Hardness sampling should be performed in conjunction with sampling for hardness -dependent metals (cadmium, copper, lead, nickel, silver, zinc). 8. See Special Condition A. (10.). 9. Whole Effluent Toxicity shall be monitored using the Pass/Fail Chronic Toxicity test with Ceriodaphnia dubia at 5.3% effluent. Samples shall be taken in March, June, September and December [see A. (4.)]. 10. The Permittee shall perform three Effluent Pollutant Scans during the term of this permit [see A. (6.)]. b. The Permittee shall sample instream hardness, upstream of the facility's discharge at the Salisbury WTP River Pump Station in the South Yadkin River. The sample shall be representative of the hardness in the receiving stream. b. As per 15A NCAC 2B.0505 (c) (4), stream sampling may be discontinued at such time as flow conditions in the receiving waters or extreme weather conditions will result in a substantial risk of injury or death to persons collecting samples. In such cases, on each day that sampling is discontinued, written justification for the discontinuance shall be specified in the monitoring report for the month in which the event occurred. This provision shall be strictly construed and may not be utilized to avoid the requirements of 15A NCAC 2B.0500 when performance of these requirements is attainable. When sampling is discontinued pursuant to this provision, stream sampling shall be resumed at the first opportunity after the risk period has ended. CHRONIC TOXICITY PERMIT LIMIT (Quarterly) [15A NCAC 02B .0200] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 5.3% at 12.5 MGD and 4.0% at 20.0 MGD. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," (Revised December 2010, or subsequent versions) or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised December 2010, or subsequent versions). The tests will be performed during the months of March, June, September, and December. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010, or subsequent versions). All toxicity testing results required as part of this permit condition will be entered electronically using the Division's eDMR system for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three-month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective. MERCURY MINIMIZATION PLAN (MMP) [NCGS 143-215. 1(b.)] The Permittee shall maintain and continue to implement the Mercury Minimization Plan (MMP) developed in the previous permit term. The MMP shall continue to be available for inspection on -site. The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. Performance of the MMP will meet the requirements of the TMDL (Total Maximum Daily Load) for mercury approved by USEPA on October 12, 2012, unless and until a Waste Load Allocation specific to this facility is developed and this NPDES permit is amended to require further action to address the Waste Load Allocation. A. (9.) NUTRIENT REOPENER FOR HIGH ROCK LAKE [NCGS 143-215.1(b)] This permit may be reopened and modified to implement nutrient requirements in accordance with any future TMDL, management strategy and/or nutrient criteria for High Rock Lake.
