According to the 7ordan rules, a local government may accept a call made by another certified individual [see 15A NCAC 02B .0267 (4)(d)]. In this case, the call was made by a DWR staff person who is certified to make stream calls. It is DWR's understanding that the Town is accepting the April 4th call and will not be making another determination. I received your request for an appeal of the April 4, 2014 call and have asked 7ennifer Burdette to contact you to schedule a time to make the appeal call. DENR has asked us whether we accept it, and we do. We see no problem with them accidentally doing it. I understand you are looking to appeal their classification. That appeal should go to them. In fact, the current owners had their attorney request that stream determination back in 2004. I have a signature from lane and Robert Slater giving permission for that request. So I'm not sure why there was any confusion as to who had jurisdiction in the first place. At the appropriate time we will be requesting a determination by the Town. And hopefully will agree with your results. But the Ownet needs to get back into Town. Basically Ncdenr is saying that the whole process needs to start with the Town.
