Dear Dr. Castleberry:
The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the subject facility. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency (EPA) dated May 9, 1994, or as subsequently amended.
The Division's renewal evaluation included a reasonable potential analysis (RPA), performed in accordance with NPDES
permitting and additional guidance specific to dischargers to water supply (WS) waters. Based on your discharge Monitoring
Reports (DMRs) submitted over the last permit cycle, the Division has made the following decisions regarding to your
previous permit:
• Benzene — (not detected) deleted limit; retained monthly monitoring.
• EPA Test Method 625 — (no parameters detected) deleted from permit per 2005 SOP
• Naphthalene — (not included in previous permit) added monthly monitoring; no limit.
• Phenol — (not detected) deleted permit limit; retained monthly monitoring.
If any parts, monitoring frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the
right to an adjudicatory hearing, upon written request, within thirty (30) days following receipt of this letter. You must submit
this request in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and file it
with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a
demand is made, this permit shall be final and binding.
Please notice that this permit is not transferable except after notifying the Division of Water Quality. The Division of Water
Quality may modify, or revoke and reissue this permit. This permit does not affect your legal requirements to obtain other
permits required by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or
other federal or local governments.

TransMontaigne Product Services, Inc.
is hereby authorized to discharge wastewater from outfalls located at the
TransMontaigne, Southeast Terminal
Guilford County
to receiving waters designated as an unnamed tributary of East Fork of the Deep River within the Cape
Fear River Basin in accordance with effluent limitations, monitoring requirements, and other conditions
set forth in Parts I, If, III and IV hereof.
This permit shall become effective September 1, 2006.
This permit and authorization to discharge shall expire at midnight on August 31, 2011.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked, and as of this
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate
and discharge from this facility arises under the permit conditions, requirements, terms, and provisions described herein.

map) into an unnamed tributary of the East Fork of the Deep River, a waterbody classified as

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
Beginning on September 1, 2006 and lasting until expiration, the Permittee is authorized to discharge
from Outfall 001. Such discharges shall be limited and monitored by the Permittee as specified below:

1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge." Flow shall be monitored with each discharge event
and may be monitored in one of four ways:
a. measure flow continuously;
b. calculate flow based on total rainfall per area draining to the outfall; exclude built -
upon area (best method for facilities with large runoff -collection ponds);
c. estimate flow at 20-minute intervals during the entire discharge event; or
d. report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed
from the surface of a quiescent (calm water) zone.
3. MTBE — See Part A.(2.) for other requirements relating to MTBE
4. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(3.)].

The Permittee shall not discharge floating solids or foam visible in other than trace amounts.
The Permittee shall not discharge tank solids, tank bottom water, or the tank rag layer.
The Permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L.

A. (2.) MTBE MONITORING - SPECIAL CONDITION
For the protection of public health, oil terminals that discharge to waters classified as water supply (WS
waters) will adhere to the following action plan: As stated in Part A. (1), the Permittee shall monitor MTBE
monthly for the duration of this permit. If, after one year of monthly monitoring, MTBE is not detected (or,
after twelve consecutive data points have been collected over a minimum six-month period), the Permittee
may request the Division to reduce the MTBE monitoring frequency. The Division shall consider such a
reduction a minor permit modification.
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test.
Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The Permittee will
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date
of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by
June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next
discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results, required as part of this permit condition,
will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the
appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate follow-up testing to be completed no later than the last day of the
month following the month of the initial monitoring.

Comments on the DRAFT from the Region
Joe,
I've reviewed the subject draft permit and offer the following:
1) Facility has been inspected by WSRO staff in each of the last two (2) fiscal years
2) No problems/violations were noted during these inspections
3) On page 2 of your fact sheet "Discharge Monitoring Reports (DMRs) -- Effluent Data
Review" you stated that the "permittee reported a maximum discharge of 0.675 MGD
(September 2004)". On page 3 of the fact sheet, you state that the "highest flow recorded
= 0.675 MGD (Jul 2004)". Are these the supposed to be the same? May just be a typo.
WSRO has no further comment and recommends issuance of the subject permit.

On the basis of thorough staff review and appli-
cation of NC General Statute 143.21, Public law
92-500 and other lawful standards and regula-
tions, the North Carolina Environmental Man-
agement Commission proposes to issue a Na-
tional Pollutant Discharge Elimination System
(NPD ES) wastewater discharge permit to the
person(s) listed below effective 45 days from
the publish date of this notice
Written comments regarding the proposed per-
mit will be accepted until 30 days after the
publish date of this notice. All comments re-
ceived prior to that date are considered in the
final determinations regarding the proposed
permit, The Director of the NC Division of Wa-
ter Quality may deride to hold a public meet-

wastewater into Little Alamance Creek in the

ter quality limited. This discharge may affect fu-
ture allocations in this portion of the Cape Fear
River Basin.
Oak Ridge Military Academy [2317 Oak Ridge Rd
Oak Ridge, NC 273101 has applied for renewal
of permit NC0046043 for its WWTP in Guilford
County. This permitted faci!ity discharges
treated domestic wastewater to the Haw River
in the Cape Fear River Basin. Currently BOD,
ammonia nitrogen, dissolved oxygen, fecal
coliform and total residual chlorine are water
quality limited. This discharge may affect fu-
ture allocations in this portion of the Haw River.
TransMontaigne Terminaling, Inc (NC0026247)
has applied for renewal of its permit discharg-
ing to the East Fork of the Deep River located
within the Cape Fear River Basin. No param-
eters in this permit are water -quality limited.
This discharge may affect future wasteload allo-
cations to this receiving stream.

INTRODUCTION
TransMontaigne Terminaling, Inc. (herein referred to as TransMontaigne or the permittee) requires a
National Pollutant Discharge Elimination System (NPDES) permit to dispose treated wastewater to
the surface waters of the state. The Permittee's 5-year NPDES permit has expired and they have
requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes
background information and rationale used by the Division's NPDES Unit to determine permit limits
and conditions.
FACILITY DESCRIPTION
TransMontaigne operates the TransMontaigne Southeast Terminal -- a bulk -petroleum storage facility and
distribution center in Guilford County (Table 1). This facility controls stormwater runoff utilizing a Water
Pollution Control System consisting of: loading rack drains; oil/water separator; waste holding tank with
optional offsite disposal; gravity drains to dike containment areas; and discharge control valves. Discharge
travels to a drainage ditch, then to an unnamed tributary (UT) to the East Fork of the Deep River.

HISTORY AND DATA REVIEW
Facility Inspections. Due to staff shortages and regional priorities, this Class I Stormwater
Treatment System has been assigned lower priority relative to other discharge systems, however, the
Winston-Salem Regional Office has scheduled regular annual inspections of this facility.
Waste Load Allocation (WLA). This permit became effective August 1, 2001 with an expiration
date of March 31, 2006. The Division reviewed the WLA in November 1994 and developed effluent
limits and monitoring requirements based on an in -stream waste concentration (IWC) of 100% (zero -
flow stream). The Division judges these limits and monitoring requirements to be appropriate for this
renewal with the exception of additions and deletions listed below (see PERMITTING APPROACH
SUMMARY).
Verifying Existing Stream Conditions. This facility discharges under "zero -flow" receiving -
stream conditions to an unnamed tributary (UT) of the East Fork of the Deep River [17-2-(0.3)], a
Class WS-IV stream within the Cape Fear River Basin. East Fork of the Deep River does not appear
on the Division's "impaired" waterbody list, i.e., is not 303(d) listed.
Discharge Monitoring Reports (DMRs) — Effluent Data Review. DMRs were reviewed from
January 2003 through December 2005. Discharges from Outfall 001 occurred episodically, but
usually several times or more per month. The Permittee reported non -discharge months as "no flow"
in accordance with the permit. The Permittee reported a maximum discharge of 0.675 MGD
(September 2004).
Notices of Violation (NOVs). No NOVs were issued to this facility during this permit cycle.
Whole Effluent Toxicity (WET) Test. The facility has passed its annual acute toxicity test for the
past 10 years, from 1996 through year 2005.
PERMITTING STRATEGY
New SOP for Oil Terminals: The Division established renewal criteria for this permit according to
the NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version
September 9, 2005 (2005 SOP) and amendment (April 14, 2006).
Summary of Reasonable Potential Analysis (RPA). The 2005 SOP establishes 12 criteria for
renewal including those requiring a reasonable potential analysis (RPA). However, RPA parameters
of concern were not detected, based on the Division's review of effluent data submitted by the
Permittee. Therefore, a reasonable potential analysis was not conducted for this renewal.
EPA Method 625/ Total suspended Solids (TSS). Based on the Division's our review of the
DMRs, twice -annual EPA 625 scans did not detect semi -volatile organic compounds. Therefore
Method 625 was deleted from the permit, per 2005 SOP. Total Suspended Solids (TSS) results do not
exceed limited levels.

Phenol Calculations:
Single Outfall 001: Highest flow recorded = 0.675 MGD (Jul 2004)
Therefore, the phenol allowable concentration (or limit) for:
001 = 0.003 lbs./day x 1 mg x 1000 µg = 0.533 µg/L
8.34 0.675 MGD 1 mg
However, because phenol was not detected during this permit cycle, reasonable potential
will not be calculated, and the existing phenol permit limit will be deleted — monitoring
frequency will remain at monthly, per SOP 2005.
Permitting Approach Summary
Based on Discharge Monitoring Reports (DMRs) submitted over the last permit cycle and
information currently available, the Division has made the following changes to the previous
permit:
• Benzene — (not detected) deleted limit; retain monthly monitoring.
• EPA Test Method 625 — (no parameters detected) deleted from permit per 2005 SOP
• Naphthalene — (not included in previous permit) added monthly monitoring; no limit.
• Phenol — (not detected) delete permit limit; retain monthly monitoring.
