Glatfelter- Ecusta Division Transylvania County Dear Mr. Gussman: The Division has reviewed your request for modification of the subject permit. Your request for deletion of the BOD5 concentration limitations of 20 mg/1 in the summer and 40 mg/1 in the winter has been approved. Summer and winter mass (lb/day) limitations for BOD5 will remain a part of the subject permit. Please find enclosed one revised Effluent Limitations and Monitoring Requirements page for outfall 001. This page should be inserted into your permit. The old page may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued pursuant to the requirements of North Carolina General Statutes 143- 215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Glatfelter Company is committed to reducing the amount of treated effluent discharged to the French Broad River. A number of capital intensive projects will be completed in the next two years to reduce our water usage significantly. These projects are already beginning to affect the quantity of treated effluent that we discharge to the French Broad. As we continue with this program, we are seeing an increase in the concentration of BOD5 in our effluent, even though the quantity of BOD5 is staying constant or even decreasing. In 1997, we had two months in which we exceeded our effluent limit for the BOD5 concentration while we were well within the BOD5 quantity limits. We desire to modify our NPDES permit to eliminate the monthly average and daily maximum BOD5 concentration limits. I know that this facility is water quality limited for BOD5. Modeling was used to back calculate a BOD5 concentration limit from the permitted monthly average flow of 27.5 MGD and the mass amount of BOD5 that the model calculated the French Broad River could assimilate. When flows are constant, there is no problem with a concentration limit. But as we reduce total water usage, the concentration limit becomes a limiting factor even though the mass of pollutants discharged is decreasing. This will allow us to continue our efforts to further reduce the amount of treated effluent discharged into the river while maintaining compliance with the quantity of BOD5 discharged. Transylvania County Please note the attached 10/31/97 memo from Kay Dechant of our Asheville groundwater staff requesting that the existing groundwater monitoring conditions in the subject permit be modified. That memo explains the reason for the proposed changes as well as recommendations for the modified language. Kay indicates that Ecusta personnel agree with the proposed modifications. The last changes in the groundwater monitoring requirements were made, via a 11/9/87 permit modification letter from Paul Wilms, as a result of a 10/13/97 memo from ARO staff (copies attached). By omission, the groundwater monitoring requirements have never been incorporated into the NPDES permit, but are required according to a permit modification letter (copy attached). I am requesting that NPDES Permit No. NC0000078 be amended to reflect changes in the groundwater monitoring requirements. A review of the historical data indicates that some of the previously required sampling parameters may be deleted, the VOC requirement updated, and the sampling frequency reduced from three times per year to twice per year. I have discussed the proposed changes with Ecusta and they are in agreement. Nowell' SUBJECT: Tentative effluent limits for P.H. Glatfelter - Ecusta Division NPDES Permit No. NC0000078 Transylvania County Per your request, the Instream Assessment Unit has reviewed two scenarios of reduced wasteflow for the Ecusta plant. A Level B modeling analysis was performed for a segment of the French Broad River, that included the Ecusta facility and two other dischargers, Town of Brevard WWTP and E. I. Dupont on the Little River. The modification of Dupont's wasteflow expansion to 3 MGD was included, in addition to recently updated streamflows on the French Broad and the Little River. Model runs were requested with Ecusta's wasteflow reduced from the permitted flow of 27.5 MGD to 13 and 15 MGD, respectively. The results of those runs for BOD5 are indicated as follows: Ow 13 MGD 15 MGD BOD5 (mg/I) 59.3 (summer) 118.6 (winter) 51.6 (summer) 81.6 (winter) BOD5 (lbs/day) 6429.3 (summer) 12858.6 (winter) 6455.2 (summer) 10208.2 (winter) An effluent limit for dissolved oxygen of 5 mg/1 is also recommended at each wasteflow. At both wasteflows, the summer predicted DO minimum in the French Broad River is 5.1 mg/l. Although the concentration limit for BOD5 would be increased with the wasteflow reduction, the discharge must still be observed so that instrream DO violations still do not occur. Please contact me if there are questions concerning these limits. cc: Forrest Westall Colleen Sullins WLA File Ecusta jmn French Broad River C 7/18/97 040301 Per request of Kerry Becker in ARO, looked at what BOD5 limits Ecusta would receive if there was a wasteflow reduction from 27.5 MGD to 15 or 13 MGD. Problem that plant was having was that it was meeting the BOD5 water quality based lbs/day limit of 4587 but was exceeding the concentration limit of 20 mg/1, because of the reduction in flow. Average Qw for the past year was about 22 MGD over 5 MGD less than permitted flow. In May 1997, self monitoring report noted that facility was meeting the lbs/day limit easily but was now exceeding the concentration limit probably due to flow reduction. DO = 4.84 mg/1. 4/2/98 Ecusta has requested the removal of the BODS concentration limit of 20 mg/1 in the summer and 40 mg/1 in the winter. Plant is voluntarily undergoing water conservation efforts and this may have some effect on the BODS concentration. The BODS lb./day limit is being met without problems. Reviewed Qw, and BODS data from 1996 thru Jan. 1998. There were violations of the summer monthly BODS concentration limit of 20 mg/1 during the months of April and May 1997. Average BODS Mass data were well below the limit of 9904 lbs/day at 4231 lbs/day and 38751bs/day, respectively. In Sept. 1997, average BODS concentration was 19.3 mg/l, while the mass limitation was 3306 lbs/day. Discharge data shows that Ecusta has consistently been below its permitted flow limit and BODS mass limit. There have been no instream DO violations in latter 1997. Will recommend that the concentration limit for BODS be deleted, however should continue to monitor instream parameters and be sure that the DO standard is not violated in the French Broad. Co. normal Bob Gussman dropped by today and discussed briefly their compliance problems with BOD concentration limits. The mill is going through a huge water reduction process and flow is falling at 2 mgd chunks. They violated their concentration number last month by 2 mg/1 (22 verses the 20 limit they have) and this month they will be 0.5mg/1 over. They are WQ limited, but since the French Broad is the "dominate" factor in determining physical modeling characteristics of the stream, a pounds limit by itself should be able to be set without consideration of a concentration limit. Bob is going to request to Coleen a revision in their limits to lbs./day only. I hope the modeling folks can do a sensivitiy analysis on conc. verses pounds. The company is planning to make modifications to its system for the next permit cycle that should get them consistantly below 15 mg/1 BOD. Until then we are going to have to address compliance issues with conc. They have no problems complying with their pounds limit. FYI. Currently, the permit is limited in terms of both concentration and pounds. BOD5 is water quality limited. This wasn't a problem until their flows dropped from about 27 MGD to about 21 MGD. While pounds is being met their concentration has increased to 22 mg/1, a violation. They have plans to drop flows to 15 MGD thus driving concentrations even higher. With my severely limited knowledge of the modeling programs in use, I will undoubtedly need your guidance. Could you look into this and advise me? Glatfelter Company Transylvania County Dear Ms. Sullins: Our current NPDES Permit became effective on October 1, 1995. In Section A(1) and (2), monthly monitoring of settleable solids of the discharge from our 001 outfall was required. In Section 4 of the cover letter dated August 30, 1995 to this permit, it was noted that "P. H. Glatfelter may apply for a permit modification with respect to settleable solids at such time as 12 consecutive months of effluent data indicate no significant water quality concern. A long-term average settleable solids volume of 5 ml/1 is acceptable." Settleable solids measurements of grab samples drawn from outfall 001have been taken since July 26,1995. A copy of these measurements is attached. They indicate that settleable solids in the effluent discharged to the French Broad River were never above the method ND level of 0.5 mg/1. Because the settleable solids testing conducted at outfall 001 indicated that the settleable solids in this discharge were significantly less than 5 ml/l, we are requesting that continuing monitoring for this parameter be deleted from our current permit. As you advised on July 22, enclosed is a check for One Hundred Dollars since this request will be considered as a "minor modification" of our current permit.
