The Division of Water Quality (DWQ or the Division) hereby issues this permit pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 10, 2007, or
as subsequently amended.
We have attached change -pages for your active permit. Please inset these pages into your existing
permit and discard the old pages.
The Division applauds your decision to transport and dispose offsite your loading -rack
spillage/stormwater wastes, previously treated onsite by a now -inactive oil/water separator. Based
on our review of your effluent data for BTEX, Naphthalene, and Phenol. (not detected in 26 / 27
consecutive months), the Division will relax 1/Month monitoring for all three parameters to
1/Quarter, as you requested. However, the Division has added a footnote. Be advised that any
future analytical detection of a given parameter will immediately reinstate 1/Month monitoring
for that parameter [see Footnote; permit section A. (1.)]. .:
If any parts, measurement frequencies, or sampling requirements contained in this permit
modification are unacceptable, you have the right to an adjudicatory hearing upon written request
within thirty (30) days after receiving this letter. Your request must take the form of a written
petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with
the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-
6714. Unless such demand is made, this permit remains final and binding.

This permit modification is not transferable except after notifying the Division of Water Quality. The
Division may require modification, or revocation and re -issuance of this permit. Please notice that
this permit does not affect your legal obligation to obtain other permits required by the Division of
Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other federal
or local governments.

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
Beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to
discharge from Outfall 001. Such discharges shall be limited and monitored by the Permittee as

Footnotes:
1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge." Flow shall be monitored with each discharge event
and may be monitored in one of four ways:
a. measure flow continuously;
b. calculate flow based on total rainfall per area draining to the outfall; exclude built -
upon area (best method for facilities with large runoff -collection ponds);
c. estimate flow at 20-minute intervals during the entire discharge event; or
d. report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed
from the surface of a quiescent (calm water) zone.
3. If this parameter is detected during routine 1/Quarter monitoring, the Permittee shall immediately
notify the Division and immediately revert to 1/Month monitoring until permit expiration.
4. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(3.)].
Units: mg/L = milligrams per liter
µg/1 = micrograms per liter
lbs./day = pounds per day
MTBE = methyl tertiary butyl ether
The Permittee shall not discharge floating solids or foam visible in other than trace amounts.
The Permittee shall not discharge tank solids, tank bottom water, or the tank rag layer...
The Permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The Permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results, required as part of this permit
condition, will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate follow-up testing to be completed no later than the last day of the
month following the month of the initial monitoring.

07AprO9 -- Joe received assignment to MOD permit.
16AprO9 -- Joe reviewed Permittee's MOD request; consulted with Charles Weaver and
Sergei (NPDES) and we concluded that this is a "major MOD" in that we are requested to
relax monitoring of BTEX and phenol from 1/Month to 1/Quarter, and abandon an
oil/water separator. This may require a site visit from the regional office. Therefore Joe
will send an email to Barbara Castleberry (Environmental Coordinator/Permittee)
requesting a Fee ($260).
After review of the Bulk Storage Policy (2005), monitoring for the parameters Phenol
and Benzene in discharges to WS waters should likely remain at 1/Month because of their
low-level respective instream standards. Others may be relaxed to 1/Quarterly.
Therefore, frequency MOD may likely consider T,E,X, and Naphthalene. MOD is on
hold pending receipt of $260 check from Permittee.
04May09 -- received Permittee's fee check for mod request ($260); Dina updated
BIMS.
28May09 — [From their letter request], the Permittee now hauls offsite the stormwater
and spillage wastes from the truck loading -rack (previously treated onsite by an oil/water
separator). This separator is no longer in use. Joe reviewed DMRs and BIMs data for
BTEX, Naphthalene, and Phenol (single compound). Data suggest no hits in 26 to 27
monthly samples from Sep2006- Apr2009 (data outlier: phenol reported in Feb2007 @
"100.0 lbs/day" suggests data input error). Permittee's request to relax monitoring from
1/Month to 1/Quarter appears reasonable.
09June09 -- Joe generated DRAFT cover letter and change -pages. Despite the concern to
protect WS waters, the Division will relax 1/Month monitoring to 1/Quarter (based on
the above). However, we will add a footnote to Section 1 (A.) immediately reinstating
1/Month monitoring for any parameter detected quarterly.

Barbara - In your letter received April 7, you've asked us to consider relaxing
parameter monitoring, and also mention alterations to your treatment system. Because
your permit, if modified, will become markedly less stringent and may require a site
inspection, the Division and EPA define this as a "major" rather than a "minor"
permit modification - major mods require a fee of $260, Public Notice, and a
mandatory draft permit 45-day waiting period.
Therefore, please send us your check for $260 via the Mail Service Center address on
your request, attn Dina Sprinkle, and we will continue to process your modification
request.

Dear Mr. Corporon:
TransMontaigne makes notification that the canopy installation has been completed at
our Greensboro Southeast Terminal.
Effective March 6, 2009, storm water runoff from the truck loading rack area is routed to
an aboveground storage tank for eventual haul off to a licensed recycling facility. These
waters are no longer discharged from the oil/water separator which is no longer active.
TransMontaigne requests the NPDES permit be modified to reflect this change.
Additionally, TransMontaigne requests a reduction in monitoring for Benzene, Toluene,
Ethylbenzene, Xylene, Napthalene, and Phenol from monthly monitoring to quarterly
monitoring.
