The Division of Water Quality (the Division) has received and reviewed your request to modify permit
monitoring requirements for Methyl Tertiary Butyl Ether (MTBE) for the subject facility, in accord with
your permit Special Condition A.(2.). We concur that your data comply with this Special Condition.
Based on your 2007-2008 analytical dataset for MTBE, the Division hereby grants a reduction in
monitoring frequency from Monthly to Quarterly for MTBE. Please add the attached permit change -
pages to your existing permit and discard the old pages.
EPA's ongoing research and evaluation of this toxicant as a potential human carcinogen raises our
concerns about your facility's discharges to a waterbody classified as Water Supply (WS-IV). Therefore
we feel your request to "discontinue monitoring" altogether is premature, and have modified your permit
consistent with existing guidance for similar fuel bulk -storage facilities across the state.
Please notice that this permit is not transferable except after notifying the Division of Water Quality. The
Division may modify, or revoke and reissue this permit. This permit does not affect your legal
requirements to obtain other permits from the Division of Water Quality, the Division of Land Resources,
the Coastal Area Management Act, or other federal or local governments.

Footnotes:
1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge." Flow shall be monitored with each discharge event
and may be monitored in one of four ways:
a. measure flow continuously;
b. calculate flow based on total rainfall per area draining to the outfall; exclude built -
upon area (best method for facilities with large runoff -collection ponds);
c. estimate flow at 20-minute intervals during the entire discharge event; or
d. report flow based on discharge pump logs.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed
from the surface of a quiescent (calm water) zone.
3. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(3.)].
Units: mg/L = milligrams per liter
µg/l = micrograms per liter
MTBE = methyl tertiary butyl ether
The Permittee shall not discharge floating solids or foam visible in other than trace amounts.
The Permittee shall not discharge tank solids, tank bottom water, or the tank rag layer.
The Permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 pg/L and toluene concentration is less than 11 pg/L.

TransMontaigne requests authorization to discontinue monitoring for MTBE.
Part A. (2.) MTBE Monitorint, — Special Condition of the referenced permit states that the
Permittee may request the Division to reduce the MTBE monitoring frequency.
The enclosed analytical result summary shows that MTBE was not detected above method
detection limits for the last twelve (12) consecutive discharge activities.
We appreciate your consideration of our request to discontinue monitoring for this parameter and
ask that a written response be provided to me at your earliest convenience.
