On June 1, 2022, Lauren Garcia with the Raleigh Regional Office conducted a site visit to determine whether the facility was compliant with coverage under Stormwater General Permit NCG020000. It was concluded that coverage under NCG020000 is not needed due to the lack of stormwater discharge from this site. This mine does not have any outfalls and therefore no stormwater discharges. All industrial water drains internally, the berms are heavily vegetated. The mine will be reclaimed and the mining permit will be closed out. With this letter, your application is being returned to you. Please be advised that if the State determines that discharges from this site contribute to a water quality standard violation or are a significant contributor of pollutants to waters of the U.S., the Department of Environmental Quality (DEQ) is authorized to require a discharge permit. If operations at our facility change such as that an NPDES stormwater discharge permit is required, then you must submit an application and receive permit coverage prior to any discharge. The return of this application does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local government permit or approval that may be required.
