application: The existing conditions on site consist of a forested land with a CP &L and NCNG gas easement bisecting the
property and some dirt roads cutting through the property. The general land use in the vicinity of the project is residential.

stormwater devices) for a residential subdivision. Equipment such as bull dozers; bucket loaders, excavators and

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S &EC completed a stream & wetland delineation for the entire property in order to identify natural resource. The
overall proposed impacts consist of permanent impacts associated with a road crossing and temporary impacts
associated with utilities (i.e. stormwater piping and sanitary sewer). Specifically, impact Areas 4, 5, 6 & 7 are
proposed temporary impacts to wetlands andl or a stream for sanitary sewer. Impact Areas 6 & 7 are proposed
aerial crossings to Rockfish Creek and two wetland areas but temporary impacts will be necessary for construction.
impact Areas 4 & 5 are proposed to be open -cut. Impact Area #1 is a proposed temporary impact to a wetland and
stream for an underground stromwater piping system. Jack & bore and directionally drilling to avoidlminimize these
impacts were reviewed for these sanitary sewer impacts. Previous Impact #2 has been eliminated from the plan
and will be jack & bored, however it was determined to be cost prohibitive to construct the other four (4) sanitary
sewer impacts with this method. Please note that Impact Area #1 was minimized by directly connecting from the
edge to edge of the wetland area vs. originally running along the lot lines. Impact Area #3 is the only proposed
permanent impact which is a road crossing necessary for access to the western portion of the property. Impact Area
#3 includes impacts to a perennial stream and a jurisdictional wetland. The road crossing was proposed within a
narrow section of the wetland area to minimize total impacts. Two RCP's are proposed at stream crossing location
to preserve the hydrologic connectivity.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 29. With
respect to residential development conditions (NWP 29- Regional Conditions section 4.0) the applicant does not
anticipate any impacts to perennial streams associated with stormwater facilities, there are no impacts associated
with single- family recreation facilities, there are no permanent wetland or stream fills proposed within the
floodwaylfloodplain and the stream classification for this project is C (i.e. not Outstanding Resource Waters, High
Quality Waters, Coastal Wetlands or wetland adjacent to these waters). Please note however that there is a
proposed wetland impact (i.e. #1) associated with a stormwater piping system, this impact will be temporary,
additionally, the proposed sanitary sewer adjacent Rockfish Creek will be within the floodplainlfloodway however no
permanent fill is proposed within a jurisdictional areas.

Erosion & Sediment Control plan will require measures to protect water quality during construction activities.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

The proposed permanent impact to streams is below 150
linear feet, as such the applicant is not proposing
compensatory mitigation in the form of a mitigation
payment but has avoided and minimized impacts to the
maximum extent practicable. The proposed permanent
and temporary wetland impacts are greater than 0.10 acre

The West Hampton Phase II development is a 158 lot single family residential development with the associated infrastructure. It
is located on the west side of Woodspring Drive. The site meets the qualifications for a low density development. However, the
wetland impacts from the streets and utilities require 85% TSS removal. Therefore, permanent wet ponds have been designed
to treat the storm water from the development.
The storm water generated from the development will be treated through the use of two wet ponds located near the southern
edge of the development. The wet ponds are designed in accordance with the latest NCDENR BMP manual. The storm water is
transported from across the site through underground storm drainage systems. The storm water is released into the forebay of
the wet ponds. The riser (outfall) for the ponds contains a slow release that controls the one year and ten year storms. The
pond reduces the peak flow from the development to less than the predevelopment flows for each of the storm events.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands
Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many
private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential
subdivisions and small commercial developments as well as agricultural and silvicultural operations. The West Hampton -Phase
l/ project is a small residential development that will be located within an already highly developed watershed. Additionally, the
project will soon be incorporated within the Hope Mill ETJ, therefore the adjacent properties that have potential for development
will have the following regulations to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this
program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post- construction
stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed.

the proposed project, or available capacity of the subject facility. This project will connect to the City of Fayetteville's

of their treatment facility will not be exceeded.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated
with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification /CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.neeep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation
are summarized in the following table. The amount of mitigation required and assigned to NCEEP for this impact is determined by
pe ' ing agencies and may exceed the impact amounts shown below.
