I have addressed your comments on the application for the PCN submittals and I am resubmitting the entire package for review.
1. The LLC has been recorded and is enclosed.
2. As per our email yesterday the owners have signed a contract and are aware of the permitting.
3. The review fee is for less than 125 foot of disturbance. With some existing disturbance grandfathered on Ruffin Road.
An exiting pipe and riprap have been destroyed by large storms and NCDOT loop road construction and we have to
replace that pipe with our roadway construction.
4. We have submitted plans to Greensboro for buffer authorization.
5. Page 10 has been signed and dated.
6. 4 copies of all plans have been submitted.

c. Rezoning=
if the buyer elects at his sole option to proceed with the purchase of the
Property at any time during the Initial Due Diligence Period, the First Extension
of the�Due Diligence Period, or the,Second Extension of the Due Diligence
Period, he will give written notice,to the Escrow Agent along with'a copy of the

As owners of record, Sellers will be required to sign the zoning petition. Sellers
to assist in rezoning request by attending meeting and supporting request, if
requested by Buyer.

for storm water and any /all impacts to the streams /wetlands on the combined
Properties. Buyer may elect to work with the City of High Point and the Town of
Jamestown as an altemathre means of obtaining water and sewer to the
Property if the City of Greensboro agrees to the extension of other cities'
utilities to service the Property. Buyer will start an of the required engineering
drawings immediately after the rezoning of the Property (provided a
commitment to extend water and sewer Ones to service the'Property has been
obtained and at a cost to Buyer that still makes the development of the
Property economically feasible). Buyer and his consultants will work diligently to
complete all of the plans, drawings, and to obtain the required approvals and
will close within 30 days after the required permits and approvals have-been
obtained. in the event Buyer has not obtained all of the required approvals
within six months of rezoning, he will provide Seller notification of the status of
any outstanding permits and approvals, and upon doing so will be automatically

On May 1, 2014, the Division of Water Resources (Division) received an application requesting a
401 Certification and Buffer Authorization from the Division for the subject project. The
following information was omitted and is necessary for the processing of an application:
1. When the applicant is a corporation, the Division requires the state in which it is
domesticated, the name of its principal officers, the name and address of the NC
process agency and the name of the individual who shall be primarily responsible
(pursuant to 15A NCAC 02H .0502 (a)(3)). Lafayette Landing Apt. and Villas, LLC is not
listed on the NC Department of the Secretary of State's Corporation website
(http: / /www. secretary. state. nc. us /Corporations /CSearch.aspx). This will need to be
resolved before the Division can process an application from Lafayette Landing Apt. and
Villas, LLC.
According to the deed and parcel information provided in the application, the current
owners of the four parcels are (1) Eva S Denny, (2) Eva S Denny Family Limited
Partnership, (3) Kevin E Stanley and (4) Norma Jean Barham, Charles T Brown and
Robert D Brown, not Lafayette Landing Apt. and Villas, LLC. When the applicant does
not have title to the property, documentation must be provided that the applicant has
