Dear Mr. Thompson-
On May 1, 2014, the Division of Water Resources (Division) Fecelved an application requesting a
401 Certification and ,Buffer Authorization from the Division for the subject project The
following information was omitted and is necessary for the processing of an application
1. When the applicant is a corporation, the Division requires the state, in which it is
domesticated, the name of,its principal officers, the name and address of'the NC
process agency and the name of the individual who shall be primarily responsible
(pursuant to 15A NCAC 02H 0502 (a)(3))_ Lafayette Landing Apt and Villas, LLC Is not
listed on the NC Department of the Secretary of State's Corporation website

resolved before the Division can process an application from Lafayette Landing Apt and
Villas, LLC
2 According to the deed and parcel information provided in the application, the current
owners of the four parcels are (1) Eva S Denny, (2) Eva S Denny, Family Limited
Partnership, (3) Kevin E Stanley and (4) Norma Jean Barham_, Charles T Brown and
Robert D Brown, not Lafayette Landing Apt and Villas, LLC When the applicant does
not have title to the property, documentation must be provided that the applicant has
been authorized by the ownerto apply for a certification

3. A review of the Pre - Construction Notification (PCN) Form indicates this application is for
190 linear feet of stream impacts. Pursuant to 143- 2145.3D (e), a $570 permitting fee is
required to process this application. Check #4251 for $240 is enclosed.
4. The Randleman Lake Riparian Buffer Rules are implemented by the local governments,
not the Division. Please apply to the City of Greensboro for a buffer authorization for
any impacts to the protected riparian buffer.
Page 10 of 10 of the Pre - Construction Notification (PCN) Form was signed but no date
was included for the signature. Please provide a date the application was signed on
each copy of the PCN.
6. The Division received three (3) copies of plans for Sheets 2 through 7 and two (2) copies
of plans for Sheet C -5A. Please provide four (4) copies of all plan sheet associated with
the application.
Pursuant to Title 15A NCAC 02H .0507(e), the Division is unable to process your application
and your application is hereby returned. You will need to reapply to the Division for approval
including a complete application package and the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clean Water Act or
Title 15A NCAC 02B .0250 for this activity and any work done within waters of the state and /or
the protected riparian buffer may be a violation of North Carolina General Statutes and
Administrative Code.
