Subject: Approved Minor Modification
Post -Construction Stormwater Management Permit SW6100804
Shoppes at Summit
Harnett County
Dear Mr. Koon
On May 20, 2022, the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR)
received a complete application package for minor modification to Post -Construction Stormwater Management Permit
SW6100804. The proposed minor modifications are summarized on the form as; "A portion of the original residential
built -upon area will become commercial built -upon area. The percentage of residential built -upon area is being reduced
due to mire accurate data related to home footprints and driveway sizes. The built -upon areas for Food Lion and
Outparcel No. 2 have been updated to reflect as -built conditions." These modifications result in an overall decrease in
the total built -upon area for the project. Included with the application package is a completed deed restriction form
indicating that the maximum allowable built -upon area per lot is 3,500 square feet for the residential portion of the
project. Upon staff review of the application package, it has been determined that a formal permit modification is not
required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please
replace the old, approved plan sheet(s) with the new one(s) or please add the attached plans to the previously
approved plan sheet(s).
Please be aware that all terms and conditions of the permit as renewed, updated and reissued on May 2, 2022, remain
in full force and effect with the exception of recording new or amended deed restrictions that reflect the approved
modifications to the maximum allowable built -upon area per lot as indicated on the deed restriction form that was
included with the application package. Please also understand that the approval of this revision to the approved plans
for the subject Post -Construction Stormwater Management Permit is done on a case -by -case basis. Any other changes
to this project must be approved through ,this office prior to construction. The approval of this minor modification does
not preclude the permittee from complying with all other applicable statutes, rules, regulations, or ordinances, which
may have jurisdiction over the proposed activity and obtaining a permit or approval prior to construction.
