Russell Property Boiling Springs Lake, NC Stormwater runoff from this approximately 1.31 acre site is collected via sheet flow across paved parking areas or via piped networks. All stormwater runoff from the site is directed into a wet detention basin which provides approximately 3,117 cubic feet of forebay volume (3,102 cubic feet required) and 4,429 cubic feet of pond volume (2,864 cubic feet required). The surface area of the pond (not inclusive of forebay) is 5,196 square feet which is over double the minimum required pond surface area of 2,516 square feet. The overall goal of the wet detention pond is to provide a minimum of 90% total suspended solid removal from runoff of the first 1" of rainfall. At the depths and dimensions as designed, the pond should achieve this objective for at least the first 1" and will actually `treat' runoff in excess of 1" rainfall. For major storm events where runoff volumes exceed the `treatment' volume, a large outlet structure and outlet pipe have been designed to be capable of accommodating the 100 year design storm while still maintaining some freeboard. Enjoyed the pictures. I just wanted to let you and Mr. Russell know that I really need to hear fronhim (not you) regarding his project, and get it permitted. If he doesn't yet know how the project will be developed, he needs to apply for a general stormwater permit for clearing and grading. This permit will make it a violation to construct any built -upon area,. or subdivide and sell off the property without first getting a development permit. If I don't have either an application or a status letter indicating the date by which an application will be submitted (reasonable) by December 30, I'll have to start an enforcement action. The site submitted for the SEC permit around September 23, 2003, over two months ago, and I returned the original stormwater application for a low density permit on September 30, 2003, due to multiple deficiencies. Russell, Owner 540 Kennedy Circle Boiling Spring Lakes NC 28461 Dear Mr. Russell: This office has received a soil erosion and sedimentation control plan for the project listed below which was submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4)). Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil erosion control plan prior to the commencement of said land disturbing activity (NCGS 113A- 54(d)(4)). The act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan. Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ). It is suggested that you contact the Division of Water Quality at (910) 395-3900 if the ditches shown on your plan will lower the water table. The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal and State water quality laws, regulations and rules. This application is no different. The developer has a tract of land that is subdivided. An SEC plan is required. The property is cleared to make it more presentable to potential buyers. While the developer may not actually propose "improvements" or build the homes, he currently owns the lots and is the only party capable of placing restrictive covenants regarding the future built -upon area amount on the lots. This must be addressed up front by the current owner, and is not left to the person who buys the lot. Without a permit and covenants, there is nothing to require the future owners to submit a SW permit, or to limit the built -upon area on the lot, or to treat the runoff from that lot, if it is high density. "Mike" needs to decide if these lots are residential or commercial, high density or low density, and then figure out what the BUA limit for low density will be, or if he will build a common treatment system for high density, or if he will require the ultimate owner of each lot to build their own system. All of this is addressed through the permit and the restrictive covenants. The covenants are placed on the lot by the owner and let any future owners know that a SW permit is in effect for that lot, and exactly what has to be done. A little confused, you say break the acre threshold and a storm water permit is required. If client isnt going to do any improvements, why is a storm water permit required? If the property sales, then the new owner that IS planning some kind of improvements should be the responsible party, right? I was told to complete plan and application similar to sediment and erosion permit aplication, considering there is to be no improvements, And once any are planned, to submit a "modification".
