Total project length is approximately 0.6 miles. Impervious surface area will increase by about 0.11 acres. There are some wetlands adjacent to the project so we have reduced the typical section of the roadway to avoid these areas. This project will require the replacement of seven wet pipes as shown below: Stream Impacts: ` This pipe will likely be perched after replacement due to excessive slope. If so, a riprap energy dissipater pad will be placed in the stream channel at the outlet of this pipe. 2 This pipe is currently perched. We anticipate being able to correct this situation. An impervious dike will be constructed upstream of the existing pipe locations to create a small pool. Clean water will temporarily be pumped around the construction areas and will be discharged downstream. Any dirty water located inside of the construction areas will be pumped into a silt bag if necessary. Once the new pipes are in place, the impervious dikes will be removed and preconstruction streambed elevations will be restored. The wet pipes at stations 7 +08, 14 +60, 29 +10 and 31 +30 carry UT 91 to the North Fork New River. The remaining wet pipes in question carry different unnamed tributaries to the North Fork New River (Class: C; Trout; ORW). This project was reviewed for the presence of threatened and endangered species. This project will have no effect on any federally listed endangered plant or animal species. Historic compliance work has been completed (see attached). The project impacts are not significant in nature and should not remove or degrade existing water quality uses. Stormwater will be routed through grass or rock lined ditches, depending on the ditch line slope. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Overall water quality in the area will be improved by paving the ABC travel lanes. All appropriate BMPs will be used during construction. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this electronic letter, it is requested that Mrs. Marla Chambers with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. A trout buffer variance will be requested from stations 2 +50 — 6 +00, 6 +50 — 7 +80, 19 +50 — 22 +60, 25 +25 — 28 +50 and 29 +25 — 29 +75. By copy of this electronic letter, it is requested that the Division of Water Quality, 401 /Wetlands Unit, issue the appropriate permit for construction of this project. It is requested that any comments related to the 401 certification be forwarded directly to me with a copy sent to the US Army Corps of Engineers. Area of Potential Effects (A.P.E.) is approximately 982 meters (3,221 ft.) long and 15 meters (50 ft.) wide. Design plans provided. SUMMARY OF CULTURAL RESOURCES REVIEW Brief description of review activities, results of review, and conclusions: Review included an examination of a topographic map, an aerial photograph, the AsheCounty soil survey, and listings of previously recorded sites, previous archaeological surveys, and previous environmental reviews at the Office of State Archaeology (O.S.A.). Also, a visualreconnaissance of the project area was conducted on 4/23/2014. The topographic map (Baldwin Gap, N.C.-Tenn.) shows the A.P.E. is located next to an unnamed stream in a narrow valley. The road crosses the stream several times. The hillside along the east side of the road is cut by numerous drainage ways that empty into the stream. A small stream joins the unnamed stream near the mid point of the A.P.E. The soil survey shows the soilsin the A.P.E. are(from south to north), Tusquitee loam (8-15% slopes), Edneyville loam (25-45% slopes), and Tusquitee and Spivey stony soils (15-25% slopes). These are steep, well-drained soils found along drainage ways and side slopes. The aerial photograph shows the landuse in the A.P.E. is a mix of cleared (pasture?) and wooded. There are several structures (homes) located at the north end of the A.P.E. on the east side of the road. A review of information at the O.S.A. shows no previously recorded archaeological sites within or adjacent to the A.P.E. The A.P.E. has not been previously surveyed for archaeological sites. It is not included in any projects thathave been reviewed by the State Historic Preservation Office (HPO). A reconnaissance of the project was conducted by NCDOT archaeologists Caleb Smith and Damon Jones on 4/23/2014. The design plans show that most of the improvements will be within the existing r/w of SR 1393. Ashort segment at the north end of the project will be on new location. The visual examination confirmed that the A.P.E. has little potential for prehistoric archaeological sites. The road is located in a very narrow creek valley with steep ridges on each side. The road runs alongside the creek and takes up most or all of the flat land in the valley. Houses and driveways occupy the few other flat landforms. “No ARCHAEOLOGY SURVEY REQUIRED” form for Minor Transportation Projects as Qualified in the 2007 Programmatic Agreement. 1of 16 Brief Explanation of why the available information provides a reliable basis for reasonably predicting that there are no unidentified historic properties in the APE: The A.P.E. is located along a small creek in a narrow valley with steep ridges on each side. There is very little flat land in this valley, and the road, homes, and driveways take up most of it. There are no previously recorded archaeological sites within or adjacent to the A.P.E. The landforms in the A.P.E. have a low potential for archaeological sites. No further work is recommended. SUMMARY OF HISTORIC ARCHITECTURE AND LANDSCAPES REVIEW Description of review activities, results, and conclusions: Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was undertaken on April 17, 2014. Based on this review, there are no existing NR, SL, LD, DE, or SS properties in the Area of Potential Effects, which is defined as 50' from the centerline each way fi•om end to end of project. As the project will be to pave, with minimal realignment, and there are no structures within the APE, no survey is required. If design plans change, additional review will be required. Why the available information provides a reliable basis for reasonably predicting that there are no unidentified significant historic architectural or landscape resources in the proiect area: HPO quad maps and GIS information recording NR, SL, LD, DE, and SS properties for the Ashe County survey and Google Maps are considered valid for the purposes of determining the likelihood of historic resources being present. There are no National Register listed or eligible properties within the APE and no survey is required.
