Accordingly, we are forwarding the updated NPDES permit pages (3,4, and 9). This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The final permit maintains the following significant changes identified in the letter sent to you on April 5, 2022: • In April 2021, the Town of Yadkinville submitted a Water Effect Ratio Study for copper (completed by ETT Environmental) based on the existing compliance schedule in the Special Condition A. (5) in the current NPDES permit; therefore, the effluent limitation for copper has been updated. See the updated Effluent Limitations and Monitoring Requirements table of the permit in Section A. (1.). • A notation was made concerning the Electronic Reporting Rule —NPDES Electronic Reporting Rule — Phase 2 Extension. EPA extended the Phase 2 deadline to December 21, 2025. The current compliance date, effective January 4, 2021, was extended as a final regulation change published in the November 2, 2020, Federal Register. All other terms and conditions in the original permit remain unchanged and in full effect. These modifications are issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. Pretreatment updates in response to NPDES permit modification: On December 28, 2022, 180 days after the effective date of this NPDES permit renewal, the Town of Yadkinville is required to submit to the Division a written technical evaluation of the need to revise local limits (i.e., an updated IWS/HWA-AT/STMP, or documentation of why is not needed). This action may include revising, updating, or adding to the list of Significant Industrial Users (SIUs). • As part of the local limits assessment, please provide all spreadsheets of the submitted Headworks Analysis (HWA), please make sure to include the latest NPDES effluent limits, water quality standards (WQS), and removal rates. Please include any recent LTMP data collected. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. The Division may require modification or revocation and re -issuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or any other Federal, State, or Local governmental regulations.
