RESOLUTION AUTHORIZING THE ENFORCEMENT OF THE DURHAM COUNTY
SEDIMENTATION AND EROSION ORDINANCE IN THE CITY OF DUPHAM
AND ITS EXTRATERRITORIAL AREA. -
WHEREAS, the Durham County Board of Commissioners has adopted
a Sedimentation and Erosion Ordinance pursuant to N.C.G.S. 113A-60;
WHEREAS, the enforcement of the Durham County Sedimentation and
Erosion Ordinance within the City of Durham and its extraterritorial
area will, enhance the City's regulation of development and is in the
best interest of the City;
WHEREAS, the Durham County Board of Commissioners has agreed to
enforce the Durham County Sedimentation. and Erosion Ordinance,
within
the City of Durham and its extraterritorial area; now, therefore,
BE IT'RESOLVED BY THE DUPHAM CITY COUNCIL:
Section 1. The Durham County Board of Commissioners is hereLy
authorized to enforce the Durham County Sedimentation and Erosion

copy of this resolution to the Chairman of the Durham County Board
of Commissioners and to the North Carolina Sedimentation Control
Commission.
Section 3• The City Clerk is directed to instruct the editor
of the City Code to include appropriate notation in the Durham City
Code that the Durham County Sedimentation and Erosion Ordinance is
enforced within the City of Durham and its extraterritorial area by
Durham County and that such notation appear at the beginning of the
Zoning Ordinance (City Code Chapter 24) and the Subdivision Ordinance
(City Code Chapter 15).

Section 4. This resolution shall be in f-ull force and effect -
from and after its passage.
Section-5 All resolutions in conflict herewith are hereby
repealed.
