Dear Mr. Mussellwhite:
On June 1, 2022, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources (DEMLR), conducted a compliance evaluation inspection for Southport Power Plant in 1281
Powerhouse Drive SE, Brunswick County, North Carolina.
The following observations were noted during the DEMLR inspection (please see the attached addendum for
additional information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented.

Inspection Summary:
An inspection was conducted to evaluate the close out procedures for the permit. The site is currently being demolished.
There is an erosion control plan BRUNS-2022-086 and NCGO10000 certificate of coverage NCC221387. The industrial
stormwater permit can be rescinded upon site conditions that will not contribute to stormwater pollution.
1. The industrial process has ceased.
2. Stockpiles of coal, wood chips, and TDF are removed, leaving residual cleanup. The site will be excavated to a three foot
depth to reach native soils. Less excavation can achieve the desired removal of remnant material.
3. The plant is mostly removed and they are in the process of removing all the metal and concrete from the site.
4. Wastewater components should be in compliance with NC DWR.
5. Groundwater and soil samples should be reviewed by Sue Robbins from DWM.
The site can resume Representative Outfall Status for Outfall 005 to represent all other outfalls. If a sample exceeds the
benchmark, you may need to sample all outfalls to identify where the source of the problem is. The drainage areas of the
site are in flux neccesitating the ROS.
The state post construction permit can be rescinded by removal of all Built Upon Area (BUA) on the site. There is not a form
for this process. You will need to write a letter explaining how a permit is not needed. The owners should understand that
any future actions on this site will need to go through permitting without benefit of the former BUA.
