Dear Mr. Kirby,
This is with reference to the request received on May 4, 2022 by DCM to refine State Permit No. 32-21, which was
originally issued to Oyster Harbour Homeowner's Association, Inc. on 3/24/2021 and includes the complete
replacement of the private boat ramp in the existing footprint adjacent to the AIWW in Supply, Brunswick County.
State Permit No. 32-21 is due to expire on December 31, 2024.
The action proposed in your submittal is to construct temporary repairs to the existing elevated boat ramp to extend
the structure's service life until a complete replacement can be funded. All proposed work would be limited to the 107
ft. concrete portion of the existing boat ramp. Temporary repairs would include driving timber pilings spaced
approximately 10ft. apart along each side of the existing concrete ramp. Timber support beams (double beams)
would then be installed underneath the full width of the existing concrete structure. The double timber beams would
be bolted to the new timber support pilings and wooden blocking/shims would then be installed to ensure load
transfer from the existing concrete ramp structure to the timber support beams. The proposed temporary pilings
would be removed during the future boat ramp replacement. The proposed work would be located entirely over open
water and would have negligible increases in the incorporation of square -foot area of Estuarine Waters and Public
Trust Area.
Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed
action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of
the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #32-21, as
described in your request dated May 4, 2022. By copy of this letter we are notifying the US Army Corps of Engineers
and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain
any other local, state or federal permits.

Elevated Boat Ramp Replacement (NC DEQ Permit #: 32-21)
Mr. Brock:
As previously discussed via email a few months ago, the Oyster Harbour Homeowners Association, Inc. (OHHA) would
like to request approval to construct temporary repairs to the existing community elevated boat ramp. At this time,
the proposed repairs would only involve work on the concrete portion of the existing elevated boat ramp; the lower
(waterward) approximate 107 ft. of the boat ramp. If approval of the proposed temporary repairs is granted, the OHHA
intends to rely on these repairs to gain a couple of years of service life out of the existing elevated concrete ramp
structure; until a full complete replacement can be funded.
For your review and reference, a drawing has been developed that shows the proposed temporary repairs. The
temporary repair plan involves driving timber piling at approx. 10-ft spacing on each side of the existing concrete boat
ramp. Timber support beams (double beams) will then be installed underneath the existing concrete structure across
the full width of the ramp structure. The double timber beams will be bolted to the timber support piling. Wooden
blocking / shims would then be installed to ensure load transfer from the existing concrete ramp structure to the timber
support beams.
I addition to this letter, enclosed herein are: 1.) a copy of the current DEQ / CAMA permit; 2.) a copy of the permit
drawings (as originally permitted); 3.) a copy of proposed temporary repair plans; 4.) a copy of the agent
authorization form.

This permit, issued on March 24, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these teens may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Boat Ramp Replacement
1) This permit authorizes only the elevated boat ramp, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this boat ramp and associated
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall noth R Wdct to

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
