PROJECT SUMMARY: The applicant proposes to construct a high-ground deck and a single-slip commercial docking facility along the AIWW in Supply, Brunswick County. Perry Farms Exclusive, LLC Docking Facility May 25,2022 Page 2 9. PROJECT DESCRIPTION The proposed project is located at the intersection of Songbird Ln SW and Old Ferry Rd SW (Parcel # 232KE002) in Supply, Brunswick County. The .61-acre project site is sandwiched between two working waterfront businesses and has been utilized for commercial business since the 1940's. Uses have included a shrimp boat dock, convenience store, ice/fuel store, rental cabins, and a ferry landing (See attached photos). The project site is currently an unmaintained vacant lot with remnant concrete debris scattered throughout Coastal Wetlands and deteriorating pier pilings.No permit history can be located for the project site but the applicant has provided photo documentation of historical use dating back to the 1940's. According to aerial imagery, the most recent docking facility was in place until it incurred storm damage in 2009. The parcel has been left unmaintained for at least the last 12 years. The south-facing property is located on a low-lying flood plain, approximately 3' above normal high water (NHW). The applicant's property has approximately 130' of shoreline frontage along the southern edge of the property with no shoreline stabilization. Emergent Coastal Wetlands including Spike Grass (Distichlis spicata) and Glasswort (Salicornia spp.) cover approximately .25-acre of the high ground. Areas landward of the High- Marsh consist of compacted gravel used for parking and a gravel easement for Songbird Ln SW. Smooth Cord Grass (Spartina altern flora) extends approximately 30' waterward of Normal High Water along the southeast side of the parcel. Continuing west, Smooth Cord Grass (Spartina altern flora) extends approximately 80' waterward of Normal High Water.Normal High Water reaches deep into the western side of the lot, coming within 10' of Songbird Ln SW. According to the applicant, the western side of the parcel was used as a makeshift boatramp,presumably because of its close proximity to Songbird Ln SW. The 80' Federal Chanel Setback is landward of both adjacent docking facilities and comes within 5' of the waterward edge of marsh in the project area. The width of the AIWW measures approximately 260' from marsh to marsh in the project area. The waters of the AIWW are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area(PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a high-ground deck and a single-slip commercial docking facility along the AIWW in Supply, Brunswick County. After holding a scoping meeting and receiving comments from resource agencies, the applicant has downsized his proposed design to reduce resource impacts. According to the application, a 12' x 12' open deck would be located over existing impervious (compacted gravel) on the southeast side of the property. The open deck would encroach in the USACE Right-Of-Way (ROW) but the applicant has proposed to make the free-standing, wooden structure temporary in nature based on comments from USACE. Extending south from the open deck, a 6' x 56' access pier would cross Coastal Wetlands and terminate at the edge of the 80' Federal Channel Setback {See Sheet 2 of 3). A gangway would run perpendicular to the channel and lead to a 6' x 60' floating dock, oriented parallel to the shoreline (Slip#1). The floating dock and its pilings would be located waterward of the USACE ROW and approximately 18' waterward of the 80' Federal Channel Setback but remain landward of adjacent docking facilities. The proposed floating dock would also be landward of the "Limits of Structure" line drawn between adjacent docks by USACE staff(See Image 1). The proposed 1-slip docking facility would provide dockage for a 48' commercial shrimp trawler (Registration#NC-3447 ER). Pilings would be driven along the landward side of the floating dock to prevent additional slips. Based on comments from DMF's Shellfish Sanitation section, adding one formalized slip to the existing shellfish buffer closure area would put Perry Farms Exclusive, LLC Docking Facility May 25, 2022 Page 3 the total slip count at 25 and not expand the shellfish buffer closure area. Riparian waivers were obtained from both adjacent riparian neighbors however the proposed docking facility would remain outside of both riparian setbacks. According to the applicant, water depths in the vicinity of proposed docking facility range from -1.67' NLW to -3.67' NLW. As proposed, the docking facility would extend approximately 30' from the edge of Coastal Wetlands, remaining landward of adjacent docking facilities and the % width limit but waterward of the 80' Federal Channel Setback. 10. ANTICIPATED IMPACTS As proposed, the 144 square foot open deck would be located within the 30' Coastal Shorelines buffer and would be built over existing impervious surface. The free-standing deck would be temporary in nature but would still require final approval by USACE due to the ROW encroachment. The proposed 1-slip docking facility would result in the shading of approximately 240 square feet of Coastal Wetlands and the incorporation of approximately 456 square feet of Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located in an area with water depths ranging from -1.67' NLW to -3.67' NLW. The proposed development would be located outside the adjacent 15' riparian corridor setbacks and would remain approximately 17' from existing structures to the east and approximately 55' from structures to the west. The proposed docking facility would be waterward of the 80' Federal Channel Setback but would have negligible impacts on navigation because the proposed location is landward of the existing pierhead line. Turbidity associated with the piling installation would be kept to a minimum. The parcel is currently under contract contingent on future use potential. Mr. Anderson is hoping to learn what development will be permissible within rules and regulations of Brunswick County, the State, and Federal Agencies. The parcel was historically used dating back to the 1940's for commercial use. Throughout the decades there has been a convenience store, ice store, rental cabins, and part of the NC Ferry that took people over to Holden Beach. All these uses included docks, of which there are still pilings in the water, as well as some existing concrete block structure remnants. The current property owner has neglected maintenance to the existing pier/docks for roughly a dozen years. The first time was in late October 2021 where I told him I would need to see a plan but that we would likely work with the applicant knowing the setback is where it is in the area. In mid-December 2021 he sent me a plan and below is what I told him and Greg was copied on that email. "...we would allow something in the setback but nothing as big as they have requested. (We) would be ok with the dock that is parallel to the shore but the finger piers would need to be reduced significantly or removed all together. I cant really tell them how to develop their plan but I would recommend trying to move the west end back into the cove a little more to give them more room between the dock and the channel. That being said I have attached an image that shows the line we would want to try to keep behind." To be clear, I don't mind the multiple inquires the same parcel but I want to make sure the response from navigation (department where I work) is consistent. So basically, we would allow the dock parallel to the shore but the finger piers would need to be reduced or removed to keep everything as close to the shore as possible. Lastly, after looking at the 3 maps at the end of the scoping document you sent over, I would like to remind/make you aware that there is a Federal Right-of-Way that covers part of this land and will restrict structures from being built inside that ROW. I have attached a second image showing the ROW in orange. That all being said, there are a lot of encroachments in this area in the ROW and in the Setback. Thanks. Building structures in the Atlantic Intracoastal Waterway Right-of-Way(ROW)is a tricky thing. The Corps has to give approval for any structure in the ROW and we only grant permissions based on if we deem the structure temporary in nature and constructed with material that indicate it is temporary. For example,below you ask about a deck,if the deck free standing,made of wood we would likely approve it. To know for sure you would need to apply for a consent to structure which is our permission to build things in the easement. You will need to supply a written project description including a request to place the structure(s)in the easement,spec sheets for everything you plan to place(these are typically description of the structures that show size,shape,and what it is made of Examples attached),a map showing where you want to place the structures I the easement,and the name,mailing address,phone and email of the property owner. Send that to me and I will get the write up completed and if approved by the Navigation Branch send it to Real Estate for execution. The Corps of Engineers will consult with us prior to permit issuance. For in-water work along the AIWW,we request compliance with our 2017 Manatee Guidelines.
