RE: RESTORATION ACCEPTANCE — CAMA VIOLATION #22-06D
Dear Mr. Schoninger:
This letter is in reference to the Notice of Violation # NOV 22-06D sent to NRMH Holdings, LLC dated
February 24, 2022 for unauthorized dredge and fill activities within the Estuarine Shoreline Area and §404
wetland areas adjacent to the Cape Fear River. The violation took place on property located at 1480 and
1450 Point Harbor Road in Wilmington, New Hanover County, North Carolina. This unauthorized activity
constituted development and you were requested to remove approximately 8,100 sq. ft. of unauthorized
spoil material placed within Jurisdictional §404 wetlands within the 75 ft. Estuarine Shoreline AEC. In
accordance with the North Carolina Administrative Code, Title 15A, Subchapter 7J.0410, any violation
involving development which is inconsistent with guidelines for development within Areas of
Environmental Concern (AEC) must be corrected by restoring the project site to pre -development
conditions to recover lost resources or to prevent further resource damage.
Based on the May 13, 2022 email from Mickey Sugg, US Army Corps, the restoration of the impacted §404
wetland areas is accomplished to the satisfaction of this Division. Upon my submission of an enforcement
report, NRMH Holdings, LLC will be notified as to the amount of the civil penalty for undertaking this
unauthorized activity within an Area of Environmental concern. Thank you for your attention and
