HomeMy WebLinkAbout20211524 Ver 2_CAMA Application_20220516 303 GEORGIA AVENUE WATERFRONT IMPROVEMENTS MAJOR CAMA PERMIT APPLICATION MOREHEAD CITY, CARTERET COUNTY, NORTH CAROLINA PROJECT NARRATIVE April 18, 2022 INTRODUCTION The property of 303 Georgia Avenue (PIN # 636615536553000) is a single-family residence located south of Park Avenue between the east side of Georgia Avenue and the shoreline of Peltier Creek. The shoreline of the property runs southwest to northeast for approximately 244 feet. Structures include one building over crawl space with a deck connected by public right of way by a concrete drive more than 50 feet from the normal high-water line. The property is owned by the applicant, D.A. Ballou. The project shall consist of the removal of three (3) floating piers accessed by gangways and two (2) plastic float slips. One (1) platform, one (1) boat port, one (1) floating dock, and one (1) boat lift shall be installed. A site plan of the proposed improvements is shown on Sheet C3. A soaping meeting for this project was held on May 25, 2021. PROJECT DESCRIPTION Three (3) floating piers accessed by gangways and two (2) plastic float slips shall be removed from the property. The 16' x 16' boat lift is approximately 20' from the east adjacent riparian line. Floating dock 1 is 40' long and 5' wide, accessed from platform 1 by a gangway. Platform 1 is 16' by 16', is fixed, and is accessed from land by 4' pier access. Boat port 3 consists of a floating section attached to the main boat port. The floating section is 10' long and 5' wide, accessed from platform 1 by gangway. Boat port 4 is 20' x 20'. The corner of boat port 4 is 40' from the boat lift across the channel, and over 110' from the west adjacent riparian line. No proposed structure shall extend more than a quarter of the channel width, as measured from the normal high-water line on either side of the channel. No proposed structure shall be locatedRECEIVED within 15' of the riparian lines. The maximum allowable shaded square footage is 1,952. Floating dock 1, platform 2, and boat port 3 have a total square footage of 906 square feet. The gangways are not included in these calculations. Please see the included platform dimension tables for a breakdown of these areas. EXISTING CONDITIONS Site Topography and Hydrography - The topography of the upland development site is relatively flat. The base flood elevation at the site is 7 feet (NAVD 88 datum). Land Use - The use of the site is as a private single-family residence. Wetlands - There are no known areas of wetlands in the project area. Areas of Archeological or Historic Value - There are no known areas of archeological or historic value on the site. Navigation - The proposed pier, floating docks, platforms and boat lift will be located outside of the setback from the channel. Stormwater- No discharges are proposed as a part of this project. Existing drainage patterns will remain. Existing drainage is primarily sheet flow from onsite and offsite areas over lawn. METHODS OF CONSTRUCTION Construction of the piers will be by conventional marine construction equipment including barges and cranes. The equipment will be onsite only a sufficient time to complete the pile driving and pier installation. Timber pier piles will be driven into the substrate to minimize turbidity. ENVIRONMENTAL POLICY ACT The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July 2011. This bill eliminates the requirement for an environmental assessment (EA) for any project requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C. Environmental Policy Act review. CAMA COMPLIANCE The project proponent hereby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge and belief. The project proponent hereby requests that the certifying authority review and take action on this CWA 401 certification request within the applicable reasonable period. Included in this submittal is a copy of the email from Holley Snider, environmental specialist for the Division of Water Resources, acknowledging that the scoping meeting held on May 25, 2021 complies with the DWR pre-filing meeting requirements. Project Summary: This is a second submittal for the 303 Georgia Ave. property. A previous major permit application was submitted last year however was withdrawn due to required conditions for the Morehead City Planning and Building Department. The current proposed project is for the reconfiguration of the existing 6 slip docks and two-boat floating platform to a 3 slip docking facility. 9. Narrative Description: The Darious Ballou project is located at 303 Georgia Ave., Morehead City,Carteret County. The Field Investigation Report Darious Ballou 303 Georgia Ave. Page 2 of 3 site is found by following Highway 70 East into the Morehead City town limits. Continue along Highway 70 through the 4-way lights at the intersection of Highway 24 and Bridges Street Extension for approximately .5 miles and turn right onto Mansfield Parkway. Follow Mansfield Parkway for .25 miles and turn left onto Park Drive. Continue on Park Drive then turn right onto Georgia Ave. and follow until the pavement ends. The property will be located on the left. The residential property is .71 acres(31,000 sf)in its entirety and an average of 3' above nhw.Peletier Creek runs along the south side ofthe property.The upland vegetation mainly consists of lawn grasses. The total shoreline length for the tract is 244'. The waters of Peletier Creek have approximately 2.5' lunar tidal amplitude. There is a 10' x 25' fringe of coastal wetlands consisting mostly of Smooth Cordgrass (Sp. Alterniflora) along the west side of the property. The Division of Water Resources classifies this area as SB Waters. This area of Peletier Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish.The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs.There is an existing house, driveway and shed on the high ground and three existing finger piers with 6 existing slips and a two-boat floating jet-dock within the canal. The shoreline is stabilized with existing riprap. Water depths within the proposed dock reconfiguration are-2nlw/mlw to-4' nlw/mlw depending on location. The bottom substrate is muddy with sand and no SAV were observed however there are small patches of"coon" oysters along the existing riprap. This canal branch within Peletier Creek is approximately 86.5' to 96.5' wide depending on location within the proposed reconfiguration area. 10) Proposed Development: The applicant has an existing 6-slip docking facility with an existing two-boat jet dock. The current proposal is for the reconfiguration of the existing docks and floating platform. The applicant is proposing a maximum of 3 slips which includes one-boat jet dock, one wet slip and one boatlift slip. There would be 2 slips within the canal and one on the jet dock in order to meet the Town of Morehead City Zoning and Planning criteria. The re-configuration would include one fixed pier extending from the high ground into Peletier Creek that would intercept a fixed platform, a gangway that would intercept a smaller floating platform and a larger jet dock platform,a second gangway that would intersect a side-too floating pier that would connect to a proposed boatlift. The applicant is proposing to reconfigure the existing docking facility by removing the three existing floating finger piers along this parcel. They are proposing to install one fixed 4' x 10' pier that would connect to a fixed 16' x 16' platform. There would be a 5' x 10' floating section (for gangway attachment) and a 20' x 20' boat jet dock(slip # 3)that would extend from the fixed platform via a gangway to the west. The applicant is also proposing two slips (one side-too wet sip and one boatlift slip) along the east side of the proposed fixed platform that would delineate slips one and two. A 5' x 40' floating side-too pier(slip 2)would extend to the west via a gangway and would intercept the proposed 16' x 16' boatlift(slip 1). The most waterward portion of the proposed development would not exceed a max of 22' from NHW along the west side of the property and would not exceed a max of 24' from NHW along the east side of the property. All work would be approximately 110' from the western riparian line and a minimum of 15' (20' per applicant) from the eastern riparian line. Riparian corridors were determined by channel orientation and existing pier alignment. The current proposal would reduce from eight existing slips to a total of three slips. There would be one slip with a boatlift, one wet slip,and one floating jet dock slip. The applicant states boat size would be 15' to 25' and of private Field Investigation Report Darious Ballou 303 Georgia Ave. Page 3 of 3 center console design. The water depths within the slip areas are-2' nlw to-4' nlw depending on location. 11. Anticipated Impacts: The proposed platform additions(fixed and floating), floating side-too pier,pier and boatlift would shade 946 ft2 and incorporate 1,316 ft2 of shallow bottom habitat. The development would maintain a max of 3 slips (2 in water slips and one jet dock slip). The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed additions should not be a hindrance to navigation due to the fact all portions would not exceed a max of 22' to 24' from NHW within the canal. The proposed development would also meet the minimum 15' setback from the riparian access lines. Total Shading impacts would be as follows: Proposed 5' x 40' floating side-too pier-200sf Proposed 5' x 10', floating platfor t= 50sf Proposed 16' x 1.6- fixed platform= 256 sf Proposed 4' x 10' pier=40 sf Proposed 20' x 20' floating jet dock= 400 sf Total Shaded Area=946 sf The shoreline is 244 linear feet.
