I can only provide the forms, you (or a surveyor or other representative) will have to complete them... In order to either get credit for pervious pavement or increase your allotted BUA, the permit will need to be modified. The application (SWU-101) needed to request the modification (and instructions on filling out the application) can also be found on this website under the Application Forms tab: http://portal.ncdenr.org/web/wa/ws/su/statesw/forms docs If you determine that there is additional BUA that can/needs to be allocated to the lots, a new deed restriction form will also need to be submitted. This form is on the Deed Restriction Forms tab of this same website. The fee for a modification is $505. Once the permit has been modified, the deed restrictions will need to be amended and recorded with New Hanover County. Also, the permit ownership will need to be addressed as the permittee (an LLC) is no longer active. The permit will need to be transferred to the HOA. If the HOA is not active, either all 4 lot owners will have to be listed as the permittee and sign off on the transfer paperwork OR each person will have to submit a complete application to split the permit into 4 parts. The transfer forms can be found on the Misc Forms & Documents tab on the previous website. If going with the last option, the same application as mentioned above would be needed for each lot. Transfers are free and modifications through the regular program are $505. Let me know if you have questions. I will likely have to send out another letter soon requesting a plan of action that provides a timeline of when the selected actions will occur. In order to utilize permeable pavement as a credit, the permit would need to be modified. At this point, neither a modification nor plan revision has been submitted to DWQ. #2. The permit does not need to reflect those future improvements until a time when the plans for those future improvements are finalized, designed, and ready for development. I've read the impervious guidelines very closely and plan to challenge any questionable allowances, and report future violations. Example #1, if Smith is proposing pervious concrete in any area, I will challenge this on the grounds that future construction will take place on both sides of his property. Example #2, if Smith does not disclose our communities future road widening and its impact on his lots impervious area, will challenge this omission just like I did his omissions in his building permit. My intent is not to modify the permit. The permit is still in the LLC's name. I will work with Attorney General's office to resolve the dissolution because that is a legal matter and I only have the ability to enforce the permit conditions. If anyone is overbuilt then they are in violation. I just have to let the process follow through and sometimes when legal matters are involved it can take some time. Please be patient, because I am one inspector for 7 to 8 thousand permits. If any of the members or managers for MRS Properties, LLC do not respond to me then they are in violation. With all that said, the intent is to keep the subdivision at Low Density status and transfer to the permit to the HOA when in compliance. My intent is not to modify the permit. The permit is still in the LLC's name. I will work with Attorney General's office to resolve the dissolution because that is a legal matter and I only have the ability to enforce the permit conditions. If anyone is overbuilt then they are in violation. I just have to let the process follow through and sometimes when legal matters are involved it can take some time. Please be patient, because I am one inspector for 7 to 8 thousand permits. If any of the members or managers for MRS Properties, LLC do not respond to me then they are in violation. With all that said, the intent is to keep the subdivision at Low Density status and transfer to the permit to the HOA when in compliance. I request that the Smiths be compelled to address each area of violation and bring their property into strict compliance with State Storm Water Permit SW 8060847. As a member of "Tidelands on the River" association I have individual and collective responsibility for our storm water permit, as such, I'm concerned that waivers, exceptions or outstanding violations directly impact our association's options in the future. For reasons stated above, I request access, notifications, and input to the investigation, review and remediation to the extent allowed by law. Violations 1) The Smiths have over -built the footprint of their main house, driveways, parking areas, and outbuildings as authorized in their existing and fraudulently -obtained Cama Development permit. The Smiths were able to obtain the development permit by misrepresenting the presence of State Stormwater Permit SW8060847. In bringing the Smiths into compliance with the maximum of 4,759 sq ft of impervious surface they are allowed, please consider the material facts attached. 2) Stormwater Permit SW8060847 required Smith to install a silt fence between disturbed areas and wetlands. After obtaining surveys, Smith knowingly installed his silt fence up to 20 feet within the delineated wetlands and bulldozed soil up to the silt fence. This willful activity buried wetlands under 5 feet of soil and converted the previous wetland area to yard. I request that Smith be compelled to restore the delineated wetlands. 3) Smith's construction activities crushed the drainpipe under his driveway and blocked water flow through the Stormwater system. 4) Smith removed Rip Rap from the stormwater drainage system to reinforce the earth around his driveway culvert. I request that these deficiencies be remediated. Material Facts • The Smiths property is subject to Tidelands on the River Covenants and Architectural guidelines that compel them to pave their driveway; this will add over to 2,000 sq ft Raved and impervious area to the Smiths non-comRliance with State Storm Water Permit SW8060847 • The Smith's property is subject to an easement for Tidelands on the River, the association is working to meet the New Hanover County Fire Marshal's provision by expanding the width of our road by 30" to 36" with compacted gravel. This road expansion will create an additional 300 sq ft of impervious area on the smith's property and add to their non-compliance with State Storm Water Permit SW8060847. re By willfully concealing active State Storm Water Permit SW8060847 in their CAMA development application, the Smiths were able to apply for and receive CAMA authorization to create over 10,000 sq ft of impervious surface, instead of the maximum of 4,759 sq ft of impervious surface they are limited to under Storm Water Permit SW8060847. • Mike Smith's first-hand knowledge of the active state storm water permit affecting his property from his role as developer of our community where he was active in applying for the storm water and road development permits. • Mike Smith also had an active role in drawing and personally signing the Tidelands on the River Covenants for the expressed main purpose "of ensuring compliance with State Storm Water Permit #8060847" (per covenants). • In late 2006, Beth E. Wetherill of New Hanover County mailed all owners of Tidelands on the River, including the Smiths, with notifications of the State Storm Water permits that we are subject to. The member/manager for the LLC, who signed the permit, must be contacted and/or receive a NOD for failure to notify us of the dissolution and must request the transfer (it does NOT automatically go with the property). At this point the permittee of record can modify the permit if they choose before they transfer the permit to correct current or past noncompliance issues. IF in 60 days (per the rules) we can not find or we do not hear from the permittee we can transfer the permit for just cause. HOWEVER our procedure is to first try and find the current permit and get this issue resolved. The permit will likely have to be transferred to the HOA or if that is not active, all 4 lot owners will have to be listed as the permittee and sign off on the transfer and any future application documents (such as applying for a modification).
