Director NORTH CAROLINA Environmental Quality May 23, 2022 Mr. John Wyatt Colonial Pipeline Company 5251 Hwy 153 Ste C #365 Hixson, TN 37343 SUBJECT: NOTICE OF DEFICIENCY Tracking Number: NOD-2022-PC-0077 Permit No. NCG510207 Charlotte Delivery Facility Mecklenburg County Dear Mr. Wyatt: North Carolina Division of Water Resources staff conducted an inspection of the Charlotte Delivery Facility on May 18, 2022. This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES Permit No. NCG510207. A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The following deficiency was noted during the inspection: Inspection Area Description of Deficiency Permit Failure to notify the Division when the treatment system failed. Compliance Issue: PART II STANDARDS CONDITIONS FOR NPDES PERMITS: Section E Reporting Requirements (9) Noncompliance Notification. The Permittee shall report by telephone to either the central office or the appropriate regional office of the Division as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. The treatment system reportedly failed around March 2021 per Colonial staff. First reporting of the system failure to the Division was during the May 18, 2022, inspection conducted by MRO staff. Therefore, the treatment system remained out of service for almost 14 months without notification to the Division. Remedial actions should be taken to correct this reporting problem and prevent further occurrences in the future. To prevent further action, carefully review these deficiencies and address the causes of non-compliance to prevent the recurrence of similar situations.
