On May 18, 2022, MRO DWR staff performed a Compliance Evaluation Inspection for the Pump and
Treat system present at the Colonial Pipeline Paw Creek facility under permit NCG510207. Upon
arrival, MRO staff was informed the treatment system was not in operation and had not been in
operation since some time around March 2021. MRO DWR had not received notification of the
system failure and therefore, the facility is out of compliance with the notification requirements of the
permit.
DWR staff was informed there are plans to rehabilitate the pump and treat system and put the system
back into service until a Bio-Sparge system can be installed and put into operation. A permit was
issued for the in 2016, for the installation of 23 AS/VE paired wells under deemed UIC permit
W10300341. There does not appear to be an expiration date for this permit so long as no
modifications are requested from the initial permit Notice of Intent to Construct (NOI).
Since the permittee failed to report the treatment system a Notice of Deficiency is being issued for
failure to report the non -compliant circumstance.

Comment: The permit is scheduled to expire on September 30, 2025. The permittee is planning
to rehabilitate the pump and treat system and return the treatment system to operating
status by the end of the summer.
MRO staff recommends that a follow-up visit be performed in September after the first
set of effluent results are received for the rehabilitated system.
The system is expected to be removed from service before the end of the permit cycle.
A permit rescission request is expected to be received before the permit has expired.

Comment: According to the permittee, the system failed sometime around March 2021.
Therefore, system maintenance has not been performed since the system went down.
The Operation and Maintenance information was presented in the 2020 and 2021
Annual Reports submitted to DWM, which was forwarded to DWR by the consultant.
