May 20, 2022 North Carolina Department of Environmental Quality Division of Energy, Mineral and Land Resources Asheville Regional Office Attn: Mr. Stanley Aiken, PE 2090 US Highway 70 Swannanoa, NC 28778 RE: NOV-2022-PC-0234 Permit No. NCG080866 Dear Mr. Aiken: avAttp� hQQT QOES<� I am writing you regarding the Notice of Violation I received earlier this month for our facility in Fletcher NC. A tote containing red dye was punctured during transport and the contents entered stormwater. I would like to outline the steps that Southeastern Freight Lines has taken and the next steps we are taking. The spill occurred during loading and unloading of bulk freight. When the puncture occurred, our personnel flipped the tote such that no additional material escaped, dammed the area utilizing oil dry, and tried to contain before it entered the yard and ultimately entered stormwater. Hazmat 1, our spill management company, was called. They called the NC Environmental Emergency Center to inform NC of the spill. Unfortunately, NC Environmental Emergency Center contacted Water Quality and did not contact Land Quality and neither did Hazmat 1 or Southeastern Freight Lines Inc. Southeastern Freight Lines and Hazmat 1 were under the assumption that since North Carolina was contacted, they had fulfilled the requirements, however, we now know that additional notification is necessary. We have contacted Hazmat 1 in regards to this requesting they modify their procedure to include the Regional office in the reporting of spills during normal working hours and I have informed our Safety Division of the requirement as well. Contractors for Hazmat 1 performed the cleanup within 24 hours of the event and disposed of the material. For clarification, this material was not an oil based product and according to the Safety Data Sheet, the material was not a hazardous substance or mixture. While we Real Estate Department P. 0. We have contracted with Thomas and Hutton Engineering to evaluate our sites in North Carolina and to update SWPP Plans as well as SPCC plans as needed. Since the Fletcher facility does not have bulk oil, an SPCC plan is not needed. Thomas and Hutton have inspected the facility and are in the process of updating our plan. As soon as the plan is developed, we will send to your office and implement it on site. Thank you for allowing me to respond to the Notice of Violation.
