The site is comprised of undeveloped forest land, a railroad and associated easement, the northern ROW of Cullman Avenue, and vacant land. One wetland is present on -site. The site is bound by vacant land, a sanitary sewer easement, and a powerline easement to the north, multifamily residential development to the west, multifamily residential and industrial developments to the south, and E 36th Street to the east. 4b. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Avoidance and minimization efforts were implemented during development planning and design to the greatest extent practicable in order to reduce the overall impacts on the aquatic environment. The rationale to support avoidance and minimization efforts include the following: • Wetland 1 — Impacts 1 and 2 - Permanent impacts to W1 have been avoided through the design of a pier -supported structure, in lieu of permanent grading and fill within W1. - All disturbed areas will be returned to preconstruction contours following completion of construction. - Forested wetland areas that are cleared during construction activities will be revegetated. Coir fiber matting will be installed, as needed, and a native temporary seed mix will be applied immediately following construction activities. A planting plan including the application of a native permanent wetland seed mix and the installation of native wetland live stakes and/or bare roots will be conducted to reestablish forested wetland conditions. lb. Through a partnership between the City of Charlotte and Mecklenburg County, this trail will connect parks, landmarks, and major employment centers, and will serve both passive and active recreational opportunities for greenway users, while maintaining and preserving the natural aspects of the corridor. Background Information The subject property is located along Cullman Avenue, Charlotte, Mecklenburg County, North Carolina. The subject property is bound by Little Sugar Creek and vacant land to the north, Little Sugar Creek and multifamily residential development to the west, multifamily residential development and industrial development to the south, and E 36th Street to the east. The subject property is comprised of vacant land, a sewage easement, a portion of Cullman Avenue, a railroad running from north to south, and undeveloped forest land. Vegetation found within the site is primarily comprised of sugarberry (Celtis laevigata), sweet gum (Liquidambar styraciflua), tulip poplar (Liriodendron tulipifera), giant cane (Arundinaria gigantea), Chinese privet (Ligustrum sinense), and American holly (Ilex opaca). Our client intends to construct a greenway alignment on the subject property which may require future authorization from the US Army Corps of Engineers (USACE); therefore, our client contracted with KH to perform the pedestrian survey within areas of potentially suitable habitat on the subject property to identify and document occurrences of federally listed threatened and/or endangered species. Methodology and Findings As of February 25, 2022, the United States Fish and Wildlife Service (USFWS) lists four (4) federally protected species for Mecklenburg County (Table 1). In western North Carolina, NLEB spend winter hibernating in caves and mines. Since this species is not known to be a long-distance migrant, and caves and subterranean mines are extremely rare in eastern North Carolina, it is uncertain whether or where NLEB hibernate in eastern North Carolina. During the summer, NLEB roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees (typically >_3 inches dbh). Males and non -reproductive females may also roost in cooler places, like caves and mines. This bat has also been found, rarely, roosting in structures like barns and sheds, under eaves of buildings, behind window shutters, in bridges, and in bat houses. Foraging occurs on forested hillsides and ridges, and occasionally over forest clearings, over water, and along tree -lined corridors. Mature forests may be an important habitat type for foraging. Biological Conclusion: May affect, not likely to adversely affect (MANLAA) Potentially suitable summer roosting habitat for the NLEB may be present within forested areas in the project area. The Final 4(d) rule (effective as of February 16, 2016), exempts incidental take of NLEB associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost tree during the pup season (June 1 — July 31). Kimley-Horn conducted a review of the most current maps of confirmed/known hibernacula and maternity sites for the NLEB at http://www.fws.gov/asheville/htmis/project_review/NLEB_in_WNC.html. The action area for this project is located outside of the highlighted areas/red 12-digit HUCs. There will be no blasting, pile driving, or other percussive activities associated with the construction of the project; however, tree- cutting/removal will occur. It is intolerant of full shade and excessive competition from other vegetation. Schweinitz's sunflower occurs in a variety of soil series, including Badin, Cecil, Cid, Enon, Gaston, Georgeville, Iredell, Mecklenburg, Misenheimer, Secrest, Tatum, Uwharrie, and Zion, among others. It is generally found growing on shallow sandy soils with high gravel content; shallow, poor, clayey hardpans; or shallow rocky soils, especially those derived from mafic rocks. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the Applicant proposes to construct a greenway in Charlotte, North Carolina. The information provided suggests that the proposed project will require authorization from the U.S. Army Corps of Engineers to impact Waters of the United States. No project design plans or a description of impacts to onsite habitats have been prepared or provided to our office at this time. Onsite habitats appear to be significantly disturbed by adjacent development activity. Federally Listed Endangered and Threatened Species According to the information provided, suitable summer roosting habitat may be present in the action area (50CFR 402.02) for the federally threatened northern long-eared bat (Myotis septentrionalis). Based on the information provided, the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule for this species. We encourage the Applicant to avoid any associated tree clearing activities during this animal's pup season, maternity roosting season (May 15 — August 15) and/or active season (April 1 — October 15). Although not required at this time, one or more of these free clearing moratoria would support our concurrence with a "may affect, not likely to adversely affect" determination from the action agency for this animal. Please note that on March 23, 2022, the Service published a proposal to reclassify the northern long-eared bat (NLEB) as endangered under the Act. The U.S. District Court for the District of Columbia has ordered the Service to complete a new final listing determination for the NLEB by November 2022 (Case 1:15-cv-00477, March 1, 2021). The bat, currently listed as threatened, faces extinction due to the range -wide impacts of white -nose syndrome (WNS), a deadly fungal disease affecting cave -dwelling bats across the continent. The proposed reclassification, if finalized, would remove the current 4(d) rule for the NLEB, as these rules may be applied only to threatened species. Depending on the type of effects a project has on NLEB, the change in the species' status may trigger the need to re -initiate consultation for any actions that are not completed and for which the Federal action agency retains discretion once the new listing determination becomes effective (anticipated to occur by December 30, 2022). If your project may result in incidental take of NLEB after the new listing goes into effect this will need to be addressed in an updated consultation that includes an Incidental Take Statement. If your project may require re -initiation of consultation, please contact our office for additional guidance. Our concurrence with "no effect" determinations from action agencies is not required. Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose.
