Good afternoon Colleen,
I hope you are doing well. In regards to the previous email, per the DWR regulations I believe we are under the
mitigation requirement. I've attached the sketch map above and the conversion of the square footage of impacts 4,355
SF total = 0.099 acres. In the PCN I rounded impact 1B (SCM fill) from .0785 (3,423 SF) to .079. Please let me know if my
explanation is appropriate to your email or if I need to update the PCN. As mentioned, I believe the 0.099 acres of
wetland impacts would meet the requirement for no compensatory mitigation.

I am reviewing the above reference application, and in order to complete the review, some additional information is
required:
1) The wetlands impacts listed in the PCN for this project are 0.100 acres. Pursuant to 15A NCAC 02H .0506(c),
mitigation is required. A compensatory mitigation proposal was not provided with the application. Please
provide more information on why a compensatory mitigation proposal was not provided. If a statement of
availability is not provided, additional special conditions may be required for the 401 permit, such as a pre -
construction site visit with the Division and a copy of the as-builts. Please note that if the as-builts are different
than the approved/requested amounts, a 401 modification may be required, including payment of the
application fee and any applicable mitigation requirements.
