P.A. 55 Broad Street Asheville, NC 28801 Subject: Hold — 46th Ave. Dr. NE Bridge DWQ #14 -0406 Catawba County, NC Dear Mr. Hoffman: On April 21, 2014, the Division of Water Resources (the Division) received you application dated April 15, 2014 for the subject project. Staff has reviewed the application and on May 1, 2014, Mr. Alan Johnson with this Office met with your representative, Mr. Dave Pasko at the site. Based on a review of the plan and the discussions at the site, more information and clarity is required regarding the subject project as to how state water quality standards are to be protected during construction. The application indicates that a "pump around" of the stream is proposed during construction, however, during the site visit it was indicated that most work would be conducted "in the wet", in general. In addition, it was discussed that excavated material would be removed from the creek. If the purpose is to remove excess material, above current stream level (currently upland) this should not be an issue. If the purpose is to excavate /dredge material to lower the stream, this will require additional justification and clarification. It was mentioned that the material deposited in the stream is from a failed upstream bridge, but it may also be material from further upstream and not a direct result of the failure. Stream sediment deposition and transport is dynamic and always in a constant state of flux, so any sediment deposition observed in the channel may also be a product of upstream channel characteristics Until this Office receives further clarification and information on this project regarding the items listed above, please be advised that this project will be placed on hold pursuant to 15A NCAC 2H .0507(h). In addition, this office is requesting that the Army Corps of Engineers place a hold on processing the application If you have any question, please contact Mr. Johnson at (704) 663 -1699.
