Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The following changes were made to the draft permit sent to you on April 4, 2017: • Special condition A.(5) Schedule of Compliance for Ammonia Nitrogen was changed to add interim dates to perform ammonia nitrogen source identification, preparation of a Corrective Action Plan and summary report of corrective actions. Mailing addresses for DWR's Mooresville Regional Office and NPDES permitting unit were also added for report submittal. The final permit maintains the following significant changes identified in the letter sent on April 4, 2017: • The NC 2007-2014 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Commission (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016 with some exceptions. The NC Division of Water Resources NPDES Permitting Unit is required to implement the new dissolved metal standards in all permits public noticed after April 6, 2016. Further, the freshwater standards for several metals are expressed as the dissolved form of the metals, and seven metals have hardness - dependent equations. As a result, the NPDES Permitting Unit will need site -specific effluent hardness data and instream hardness data, upstream of the discharge, for each facility monitoring these metals in order to calculate permit limitations. Effluent and upstream hardness have been added to this permit at a quarterly monitoring frequency. Footnote 5 was added to A. (1) Effluent Limitations and Monitoring Requirements in Part I to require hardness sampling in conjunction with copper sampling. • RPA results showed that zinc and cyanide do not show reasonable potential to violate water quality standards of the Indian Creek. Effluent monitoring requirements for zinc and cyanide have been removed. • Effluent limits for ammonia nitrogen have been revised based on a waste allocation model and updated guidance on NPDES Implementation of Ammonia Criteria. • Special Condition A. (5) Compliance Schedule for Ammonia Nitrogen has been added to the permit which requires permittee to identify sources of ammonia nitrogen in the effluent, preparation of a corrective action plan and submit a report summarizing the actions taken in accordance with the corrective action plan before achieving compliance with revised summer and winter ammonia nitrogen limits in condition A. (2) by May 1, 2020. Effluent limitations and monitoring requirements from the effective date of the permit till April 30, 2020 are in condition A. (1). • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. The requirement to begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your final NPDES permit. (3) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) [15A NCAC 02B .0200 et seq.] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 34%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of March, June, September and December. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWR Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh, NC 27699-1623 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. • Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid Page 5 of 10 Permit NC0044440 - test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (4) EFFLUENT POLLUTANT SCAN (Municipal POTWs) [G.S. 143-215.1(b)] The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years: 2017, 2018, and 2019. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicity test each year, and must represent seasonal variation [i.e., do not sample in the same quarter every year]. Unless otherwise indicated, metals shall be analyzed as "total recoverable." Test results shall be reported electronically via eDMR or on DWR Form — DMR PPA-1 (or on a form approved by the Director) by December 31 St of each designated sampling year. Additional Toxicity Testing Requirements for Municipal Permit Renewal. Please note that Municipal facilities that are subject to the Effluent Pollutant Scan requirements listed above are also subject to additional toxicity testing requirements specified in Federal Regulation 40 CFR 122.21(j)(5) and EPA Municipal Application Form 2A. The US EPA requires four (4) toxicity tests for a test organism other than the test species currently required in this permit. The second species tests should be conducted either quarterly for a 12-month period prior to submittal of the permit renewal application, or four tests performed at least annually in the four and one half year period prior to the application. The second species tests must be multiple concentration (5 concentrations plus the control). These tests shall be performed for acute or chronic toxicity, whichever is specified in this permit. POTWs performing NPDES chronic Ceriodaphnia testing should perform chronic Fathead minnow testing. POTWs performing NPDES acute Fathead Minnow testing should perform acute Ceriodaphnia testing. POTWs performing NPDES chronic Mysid shrimp testing should perform chronic Silverside Minnow testing. The second species toxicity test results shall be filed with the Aquatic Toxicology Branch at the following address: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1623 Contact the Division's Aquatic Toxicology Branch at 919-743-8401 for guidance on conducting the additional toxicity tests and reporting requirements. Results should also be summarized in Part E (Toxicity Testing Data) of EPA Municipal Application Form 2A, when submitting the permit renewal application to the NPDES Permitting Unit. A. (5) SCHEDULE OF COMPLIANCE FOR AMMONIA NITROGEN [G.S. 143-215.1(B)] 1. The permittee shall perform source identification of ammonia nitrogen in the effluent by February 1, 2018. 2. The permittee shall submit to the Division of Water Resources a Corrective Action Plan summarizing the actions to be taken to achieve compliance with ammonia nitrogen and schedule of activities to implement this plan by February 1, 2019. 3. The permittee shall submit a report to the Division summarizing the actions taken in accordance with the corrective action plan by February 1, 2020. 4. Achieve compliance with Ammonia nitrogen limits (See condition A. (2) ) by May 1, 2020. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the intemet. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. The plant located in Gaston County serves an estimated population of 5700. The average daily flow rate ranged from 0.46 MGD in 2012 to 0.57 MGD in 2014. The Cherryville WWTP consists of bar screen, grit chamber, oxidation ditches, clarifiers, chlorine contact chamber, cascade aeration system, sludge holding tank and sludge storage lagoon. The treated wastewater is discharged to the Indian Creek in the Catawba River Basin. The city has a separate sewer system and it is collecting 100% domestic wastewater. II. RECEIVING STREAM The Indian Creek in Catawba River Basin is classified as C waters in South Fork Catawba watershed, HUC 03050102. It is in sub -basin 03-08-35 and not listed for any impairment in 303(d) list published in 2016. III. DATA REVIEW AND VERIFICATION OF EXISTING CONDITIONS A. DMR Review DMRs were reviewed for the period of January, 2012 till December, 2016. The effluent data are summarized in Table 1. Table 1. Compliance History The compliance history from January, 2012 to December, 2016 was reviewed. The facility received three notices of violations (NOV) during this period. The weekly geometric mean of fecal coliform exceeded the permit limit in February, 2012 and an enforcement case was opened for this violation in July, 2012. The facility also received a NOV in February, 2015 for exceeding weekly geometrical mean for fecal coliform. Compliance inspections were conducted at the facility in January, 2012 and December, 2014 by the Mooresville Regional Office. The facility was reported non -compliant with the requirements of the NPDES permit in both inspection reports. The regional staff reported issues with mechanical bar screens and discrepancies in data reported on DMRs in 2012. During the compliance inspection in 2014, the Mooresville regional staff again reported compliance issues with bar screen which was rusted and not operational for years. The compliance inspection report in 2014 also reported that all pumps in influent pump station were not operable. C. Mercury Evaluation The permittee is required to monitor mercury as a part of priority pollutant analysis (PPA) using 1631E EPA method. However, the permittee used method 245.1 for the mercury analysis. As a result, mercury evaluation was not conducted as per TMDL guidance due to lack of low level mercury data. The permittee has been informed to use this method for mercury evaluation in future PPAs to have data for mercury evaluation. Since the facility is currently treating the domestic wastewater only, sources of mercury in the wastewater will be limited and the concentration of mercury in the treated effluent will not be affecting the water quality standards of the Indian Creek. Effluent limitation and monitoring requirements are not added for this parameter at this time. D. Reasonable Potential Analysis (RPA) With the approval of Triennial Review (2007-2014) of the NC Water Quality Standard (WQS) by the NC Environmental Management Committee (EMC) in 2014 and US -EPA (with some exclusions) on April 6, 2016, NPDES Permitting Unit of the NC Division of Water Resources is required to implement the new dissolved metal standards in all permits public noticed after April 6, 2016. A reasonable potential analysis using the updated NC WQS was conducted on effluent toxicant data collected between January, 2012 and December, 2016. Based on this analysis, the following permitting actions are proposed for this permit: • Monitoring Only. Copper will receive a monitor -only requirement since it did not demonstrate reasonable potential to exceed applicable water quality standards/criteria, but the maximum predicted concentration was >50% of the allowable concentration. • No Limit or Monitoring: The following parameters will not receive a limit or monitoring, since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and the maximum predicted concentration was <50% of the allowable concentration: Cyanide and Zinc. A spreadsheet of the RPA results is attached to this Fact Sheet. Page 2 of 4 E. Priority Pollutant Analysis The facility had performed three priority pollutant analysis and their results were included in the permit renewal application. Copper, zinc and nickel level were found above the detection level in these PPAs. Reasonable potential analysis has already been conducted for copper and zinc using the data from DMRs. (Please see D. Reasonable Potential Analysis for more details). Nickel was considered as a non -detected parameter due to limited data set (n<9) and just one incidence of detection below the water quality standard. All other priority pollutants were below detection level. F. Aquatic Toxicity Testing Permit holder is required to perform quarterly Whole Effluent Toxicity (WET) test using Ceroidaphnia Dubia at the effluent concentration of 34%. Total 18 WET tests were conducted from January, 2012 to December 2016. The facility had passed 17 out of 18 tests. It failed the test conducted in December, 2013 and received a NOV in February, 2014 for this violation. However, it passed two WET tests conducted at 68% effluent concentration in January and February, 2014. The facility also passed 4 second species aquatic toxicity tests. G. Instream Monitoring The permittee conducts instream monitoring for temperature and dissolved oxygen at designated points upstream and downstream of outfall 001 in the Indian Creek. The upstream and downstream sample results from January 2012 to December, 2017 were reviewed and compared to evaluate the impact of the effluent on the water quality of the Indian Creek. The dissolved oxygen level remained above 6.5 mg/1 throughout the year. Discharge from the facility did not have any impact on DO or temperature of the stream. The facility will continue instream monitoring requirements as defined in the permit. IV. COMPLIANCE SCHEDULE The permittee is required to limit ammonia nitrogen concentration in the effluent according to an updated NPDES permitting guidance for NPDES Implementation of Ammonia Criteria. The new limits for summer and winter were calculated using a waste load allocation model. The evaluation uses ammonia criteria of 1.0 mg/1 for summer and 1.8 mg/1 for winter and assumes background concentration of 0.22 mg/1. These limits were discussed with the permittee and a schedule was prepared to achieve compliance with ammonia nitrogen by May 1, 2020. (See condition A. (5)). Interim effluent limitation and monitoring requirements were added in the permit from the period beginning on the effective date of permit and lasting till April 30, 2020. (See conditions A. Limitations are required based upon a showing of "reasonable potential" to exceed water quality standards. If monitoring for a particular pollutant indicates that the pollutant is not present (i.e. consistently below detection level), then the Division may remove the monitoring requirement in the reissued permit. 1. To perform a RPA on the Freshwater hardness -dependent metals the Permit Writer compiles the following information: • Critical low flow of the receiving stream, 7Q10 (the spreadsheet automatically calculates the 1Q10 using the formula 1Q10 = 0.843 (7Q10) 0.993) • The mean annual receiving stream flow (QA), for carcinogen comparisons against HH criteria • The minimum average flow over 30 consecutive days that has an average recurrence of once in two years (30Q2) in the receiving stream, for comparisons against aesthetic standards • effluent hardness and upstream hardness, site -specific data is preferred • Permitted flow • Receiving stream classification 2. The chronic Aquatic Life water quality criteria is converted from total recoverable metal at lab conditions to dissolved lab conditions for the following metals: cadmium, copper, lead, nickel, zinc, and trivalent chromium. EPA default partition coefficients, or site -specific translators developed using federally approved methodology, are used in the RPA spreadsheet to convert the dissolved lab conditions to a total recoverable metal at ambient conditions. 3. The acute Aquatic Life water quality criteria is converted from total recoverable metal at lab conditions to dissolved lab conditions for the following metals: cadmium, copper, lead, nickel, zinc, silver and trivalent chromium. EPA default partition coefficients, or site -specific translators developed using federally approved methodology, are used in the RPA spreadsheet to convert the dissolved lab conditions to a total recoverable metal at ambient conditions. 4. For criteria that are hardness dependent, site -specific hardness data (effluent and upstream) is best to evaluate chronic and acute concentrations. The permit writer will first review DMR's, Effluent Pollutant Scans, and Toxicity Test results for any hardness data and then contact the Permittee to see if any additional data is available for instream hardness values, upstream of the discharge. If no hardness data is available, the permit writer may choose to do an initial evaluation using a default hardness of 25 mg/L and total suspended solids (TSS) of 10 mg/L to see if the permittee is impacted. Minimum and maximum limits on the hardness value used for water quality calculations are 25 mg/L and 400 mg/L respectively. The minimum TSS value used for EPA partition coefficients is 10 mg/L. Page 2 of 4 If the use of a default hardness value results in a hardness -dependent metal showing reasonable potential to violate water quality criteria the permit writer should contact the Permittee and request 5 site -specific effluent and upstream hardness samples. The overall hardness value used in the water quality calculations is calculated as follows: Combined Hardness (chronic) = (Permitted Flow*Avg. Effluent Hardness) x (7010 S*Avg. Upstream Hardness) (Permitted flow + 7Q10 S) The Combined Hardness for acute is the same but the calculation uses the 1Q10 flow. 5. EPA default partition coefficients or the "Fraction Dissolved" converts the value for dissolved metal at laboratory conditions to total recoverable metal at in -stream ambient conditions. This factor is calculated using the linear partition coefficients found in The Metals Translator: Guidance for Calculating a Total Recoverable Permit Limit from a Dissolved Criterion (EPA 823-B-96-007, June 1996) and the equation: Cdiss = 1 Ctotal 1 + { [Kpo] [ss")] [101 } Where: ss = in -stream suspended solids concentration [mg/1], minimum of 10 mg/L used Kpo and a = constants that express the equilibrium relationship between dissolved and adsorbed forms of metals. The dissolved hardness -dependent metals calculations are divided by the default partition coefficients (or translators) to obtain a Total Recoverable Metal at ambient conditions. There is one scan attched to the renewal applicaton dated Augiust 2013 but we are missing some analysis which may because we are missiing the even numbered pages (2,4,6,8, 10).
