This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994, as revised. The permit becomes effective on August 1, 2004, and expires on February 28, 2008. The Knightdale Estates permit was one of ten that were the subjects of a public hearing held in Raleigh on May 29, 2003. The Division heard comments on the permits during the hearing and also received written comments on some of those permits. We have considered all relevant comments and are now issuing the final permit, including the following changes since the April 2003 draft: • Monitoring Requirements. The treatment plant has had a poor compliance record in recent years, resulting in 16 enforcement actions from 2000 through 2002. In order to encourage more attention to plant operations, the final permit requires more frequent monitoring than in the past. The Division cart consider reducing these requirements again when the plant meet its permit limits for at least one year. • Wastewater Management Plan. In addition to its poor compliance record, Knightdale Estates has also experienced a problem common to similar properties, that is, accumulation of household grease in the collection and treatment systems. The final permit requires you to (1) evaluate the feasibility of other wastewater disposal alternatives; and (2) prepare and implement a strategy for informing its tenants of proper use of its wastewater systems. • Outfall Signage. The Knightdale Estates treatment plant discharges to a small stream adjacent to the community. There is some concern that the stream is attractive to nearby residents and their children as a play area and that there is no indication of the treated wastewater discharge. The permit requires you to post and maintain a sign identifying your wastewater discharge as such. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. There shall be no discharge of floating solids or visible foam in other than trace amounts. s Permit NC0040266 A.(2.) CALCULATION OF TOTAL NITROGEN LOADS a. The Permittee shall calculate monthly and annual Total Nitrogen (TN) Loads as follows: i. Monthly TN Load (1b./mo.) = TN x TMF x 8.34 where: TN = the average Total Nitrogen concentration (mg/L) of the composite samples collected during the month TMF = the Total Monthly Flow of wastewater discharged during the month (MG/mo.) 8.34 = conversion factor, from (mg/L x MG) to pounds ii. Annual TN Load (lb./yr.) = Sum of the 12 Monthly TN Loads for the calendar year b. The Permittee shall report monthly Total Nitrogen results (mg/L and lb./mo.) in the discharge monitoring report for that month and shall report each year's annual results (lb./yr.) in the December report for that year. A.(3.) TOTAL RESIDUAL CHLORINE The limit for total residual chlorine shall become effective upon completion of the installation of a dechlorination system but no later than 18 months from permit effective date (February 1, 2006). If a disinfection method other than chlorination/dechlorination is installed, the total residual chlorine limit and monitoring requirements will not be applicable. A.(4.) WASTEWATER MANAGEMENT PLAN a. No later than 180 days after the effective date of this permit, the Permittee shall submit to the Division a wastewater management plan. The plan shall include, at a minimum, the following elements: i. Alternatives analysis. Conduct a technical and economic evaluation of wastewater disposal alternatives, specifically including at least the following alternatives: • connection to another wastewater collection system, public or private • conversion to a spray irrigation system • implementation of a reuse program • any combination of the above option The analysis and report shall be consistent with guidance provided by the Division. ii. Communications plan. Describe a strategy for informing utility customers of their potential impacts on treatment system performance and appropriate practices for minimizing those impacts, including a schedule for implementation of the strategy. At a minimum, include the following elements: • oil and grease contributions to the collection and treatment system, • introductory material for new tenants, describing acceptable waste disposal practices, common problem practices, notification procedures in case of emergency b. Upon approval by the Division, the plan shall become an enforceable part of this permit. Permit NC0040266 A.(5.) OUTFALL SIGNAGE Not later than 120 days after the effective date of this permit, the Permittee shall install and thereafter maintain permanent signage identifying Outfall 001 as a wastewater discharge point. Unless otherwise approved in writing by the Director, the signage shall confoiin to the following specifications: a. It shall be located in reasonable proximity to the outfall. b. It shall be clearly visible to persons on the adjoining property and in or near the surrounding waters and, toward that end, shall: • be two-sided • be located at least 3 feet above ground level • at least two feet by two feet (2ft x 2ft) in size • consist of black letters on a white field; the word "notice" to be at least 3 inches tall and the remaining words to be at least 2 1/4 inches tall c. Around this time, it became apparent that the Neuse River Foundation was interested in including this facility as one in a large public hearing planned for the Neuse River. Knightdale MHP has experienced considerable non-compliance with its NPDES permit over the last three years — there are records of at least fifteen assessments of civil penalties in the NPDES correspondence files. Of particular problem seem to be flow, fecal coliform and dissolved oxygen. In October 2002, Knightdale MHP received an ATC for the construction of an equalization basin, construction of which should alleviate some of these compliance problems. As of this drafting, Knightdale MHP still has civil penalties which it is either contesting or has simply has not paid. The existing treatment system consists of a manual bar screen, aeration basin, primary and secondary clarifiers, aerobic digester, chlorinator, chlorine contact chamber and flow meter. Instream Monitoring and Verification of Existing Conditions and DMR Data Review This facility discharges to an unnamed tributary to the Neuse River (classified C-NSW). While not technically listed as impaired, this facility must be compliant with any strategies associated with the TMDL for the Neuse River Estuary. The facility monitors for instream temperature, dissolved oxygen and fecal coliform. These data were reviewed from January 2001-February 2003. Downstream temperatures were slightly elevated from the upstream levels. Dissolved oxygen downstream of the discharge was somewhat lower than the upstream values. Instream dissolved oxygen (both upstream and downstream) was lower than 5.0 mg/L throughout much of the summer of 2002. Levels did not return consistently above that level until October 2002. Downstream fecal coliform levels were generally about the same or slightly lower than the upstream values. Plots of all the instream data analyzed are attached to this document. Fact Sheet NPDES NC0040266 Renewal Page 1 Effluent data was reviewed for the period of September 2000-September 2002. The average flow was 0.0193 MGD — seven violations of the monthly average flow limit were recorded during this time period. Average BOD was 6.6 mg/L, average TSS was 8.59 mg/L and average ammonia was 3.09 mg/L. There were four violations of the ammonia limit during the period of record. The total nitrogen load reported in 2001 was 985.12 lb./yr. Correspondence This facility has consistently had difficulty meeting its limits. In 2001 alone, there were 10 notices of violation issued (with accompanying civil penalties). The majority of these were for violations of flow, fecal coliform (both monthly average and daily max), and dissolved oxygen. Failures to monitor and violations of the ammonia and BOD limits have also been recorded. The facility has contested each of the fourteen civil penalties issued since June 2000 (as per the correspondence records in Central Files). Thus far, through the appeals process, Knightdale has gained a reduction in the amount of the civil penalties ten times. They are in the process of paying off the fines for these ten cases (since December 2002, they have made nine of twelve scheduled payments); they began paying the fines on these in April 2002 (nearly two years after the first of the ten civil penalties was issued). There is no record of payment for the remaining four, all of which are from 2002. The facility received an Authorization to Construct an equalization tank in October 2002. It is the Division's hope that this will be constructed in the near future and that this will help the facility to better comply with the NPDES permit. PERMITTING STRATEGY In the previous draft, the following changes were made: • Daily maximum limits for ammonia were added to the permit as per ammonia policy implemented in October 2002. • A daily maximum limit for total residual chlorine (TRC) was added to the permit. A water quality standard for TRC was adopted by the Environmental Management Commission on October 2002. All facilities using chlorine for disinfection are subject to a daily maximum limit. The permit includes a schedule of compliance of 18 months. The Permittee has expressed an interest in installing UV disinfection, so a footnote will be added to the TRC limit that states that this limit will only be effective if chlorine is used in disinfection. Influent monitoring of BOD and TSS was accidentally put in the previous draft and will be removed. In addition, language pertaining to Total Nitrogen requirements for all Neuse facilities has been updated. The treatment facility consists of a manual bar screen, aeration basin, primary and secondary clarifiers, aerobic digester, chlorine contact chamber and effluent flow meter. The plant discharges to an unnamed tributary to the Neuse River, a Class C-NSW water with a summer 7Q10 flow of 0.19 cfs. In October 2002, the facility received an ATC for construction of a new equalization basin. Permit Summary The facility's permit contains seasonal discharge limits for BOD (27 mg/L summer & 30 mg/L winter) and NH3-N (4.8 mg/L summer & 21.7 mg/L winter). The draft permit also includes new daily maximum limits for NH3-N (24 mg/L summer & 35 mg/L winter) and Total Residual Chlorine (28 ug/L), consistent with recent changes in NPDES permitting policy. Public Comments Joe Seigler, Neuse River Foundation: • Facility has poor compliance record, over $36,000 assessed since 1985. Discharge has negative impact on low flow receiving stream, and owner does not accept responsibility. • Recommend: — educating the permit holder - he must accept responsibility for his actions; must notify DWQ of ownership and ORC changes - phase out package plants in low flow streams per Table 4.2 of the 1998 Neuse River Basinwide Plan; require an EAA with public review - require facility assessment by 3rd party, with public review - require more instream monitoring, including nutrients and benthic - DWQ should scrutinize flows reported in DMRs — reduce the NH3-N and Total Residual Chlorine limits to protect the stream DWQ Response and Discussion Compliance record has been poor in recent years: 16 enforcement actions from 2000-2002 for a total of $23,550 in penalties. The facility has contested each penalty, and most have been reduced. $1,310 in penalties is still outstanding, and owner is on a payment plan. Most limits violations have been for flow, fecal coliform, dissolved oxygen, and ammonia, and most occurred after owner switched ORCs circa 2000. Compliance has been restored for the most part since the original ORC returned in early 2003. Construction of the new equalization basin should alleviate some of these compliance problems. Summary and Recommendations Knightdale Estates WWTP, NC0040266 We surmised from our site visit that the receiving stream might be a play area for area children. In 2000, we required two permittees to install signage under similar circumstances, and it seems to be warranted in this case as well. Increased monitoring frequencies at the facility would help staff evaluate permit compliance and protection of the receiving stream. The owner needs to take whatever steps are necessary to ensure continued compliance with permit requirements. Specific needs could be identified in the permit, which would require submittal of a Wastewater Management Plan. At a minimum, the Plan should require the permittee to re-evaluate discharge alternatives, educate tenants about controlling grease, and place a sign at the discharge point. Recommended Action(s) The NPDES Unit should: 1. Include increased monitoring requirements in the final permit until the new owner demonstrates consistent compliance with the permit limits. 2. Add the following language to the permit to implement the above recommendations: A. (,) WASTEWATER MANAGEMENT PLAN 1. No later than 180 days after the effective date of this permit, the Permittee shall submit to the Division a wastewater management plan. The plan shall include, at a minimum, the following elements: • Alternatives analysis. Conduct a technical and economic evaluation of wastewater disposal alternatives, specifically including at least the following alternatives: — connection to another wastewater collection system, public or private - conversion to a spray irrigation system - implementation of a reuse program - any combination of the above option The analysis and report shall be consistent with guidance provided by the Division. • Communications plan. Describe a strategy for informing utility customers of their potential impacts on treatment system performance and appropriate practices for minimizing those impacts, including a schedule for implementation of the strategy. At a minimum, include the following elements: - oil and grease contributions to the collection and treatment system, introductory material for new tenants, describing acceptable waste disposal practices, common problem practices, notification procedures in case of emergency 2. Upon approval by the Division, the plan shall become an enforceable part of this permit. A. (_.) OUTFALL SIGNAGE Not later than 120 days after the effective date of this permit, the Permittee shall install and thereafter maintain permanent signage identifying Outfall 001 as a wastewater discharge point. Unless otherwise approved in writing by the Director, the signage shall conform to the following specifications: 1. It shall be located in reasonable proximity to the outfall. 2 Summary and Recommendations Knightdale Estates WWTP, NC0040266 2. It shall be clearly visible to persons on the adjoining property and in or near the surrounding waters and, toward that end, shall: • be two-sided • be located at least 3 feet above ground level • at least two feet by two feet (2ft x 2ft) in size • consist of black letters on a white field; the word "notice" to be at least 3 inches tall and the remaining words to be at least 21/ inches tall 3.
