On December 2, 2020, Lauren Goyne of Charlotte -Mecklenburg Storm Water Services (CMSWS),
conducted a site inspection for the Migway, Inc. facility located at 9349 China Grove Church Road,
Mecklenburg, North Carolina. A copy of the Compliance Inspection Report is enclosed for your
review. The site visit and file review revealed that the subject facility is covered under NPDES
Stormwater General Permit NCG080000 by Certificate of Coverage NCG080959. Permit coverage
authorizes the discharge of stormwater from the facility to receiving waters designated as Grants
Creek, class C waters in the Catawba River Basin.
As a result of the site inspection, the following permit condition violations are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
The permittee failed to develop and implement a Stormwater Pollution Prevention Plan
(SPPP). [Part H, Section A]
2) Analytical Monitoring
The permittee failed to conduct analytical monitoring of stormwater discharges as specified
in Table 1 and in accordance with the schedule specified in Table 2. [Part H, Section B]
3) Qualitative Monitoring
The permittee failed to conduct qualitative monitoring in accordance with the permit
requirements and schedule. [Part II, Section D]
Required Response
• A written explanation for why the violations occurred must be submitted within 15
calendar days.
• The SPPP must be completed and emailed to this office for verification within 60 calendar
days.
