On July 16, 2015, Mr. Samir Dumpor of the Washington Regional Office of the Division of
Energy, Mineral, and Land Resources (DEMLR) inspected CVS Pharmacy development in
Manteo, Dare County to determine compliance with Stormwater Management Permit
Number SW7040211.
The Stormwater Management Permit Number SW7040211 was issued on March 17, 2004 to
D&M Holdings for CVS Pharmacy located in Manteo, Dare County. The file review
discovered that the original permitee, the D&M Holdings, LLC has been administratively
dissolved as of September 7, 2004. Your Corporation, the Manteo Partners, LLC has been
identified as the owner of this development. During the site inspection it was noted that the
project is built and maintained in substantial compliance with the stormwater permit
SW7040211, however the following permit condition violations were noted:
1.) Failure to Submit Designer's Certification
Section II. Schedule of Compliance, condition No. 6 of Stormwater Permit SW7040211
requires that upon completion of construction and prior to operation of the permitted facility,
a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with the permit, the
approved plans and specifications, and in accordance with other supporting documentation.
As of the date of this letter, DEMLR has not received this certification.
2.) Failure to Change the Ownership
Section I. Design Standards, condition No. 5 of Stormwater Permit SW7040211 requires
that the change of ownership will require a modification to the permit.

receipt of this Notice. Your response should be sent to this office at the letterhead
address. Your response should provide a written "Plan of Action" which outlines the
actions you will take to correct the above violation and a time frame for completion of
those actions.

described above be properly resolved. Unresolved violations may lead to the issuance of a
Notice of Violation and/or assessments of civil penalties.
