Bean, Directorate 2175 Reilly Road, Stop A Fort Bragg, NC 28310-5000 Donald R. van der Vaart Secretary Subject: NOTICE OF DEFICIENCY (NOD-2015-PC-0063) US Army Dept. of Public Works Lamont Road C & D Land Fill, Certificate of Coverage- NCG120093 NPDES Stormwater General Permit-NCG120000 Cumberland County Dear Mr. Bean: On February 5, 2015, Diane Adams from the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources, conducted a site inspection for the Lamont Road C & D Land fill facility located off Lamont Road, Fort Bragg, Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. James Duncan with the Water Management Branch, and Drew Hammonds with the NC Division of Waste Management were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG120000, Certificate of Coverage-NCG120093. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as a UT to Bones Creek, a Class C waterbody in the Cape Fear River Basin. A. I+ f +h.. +r, �+�.�nn+;nr� the fnllniniinn rinfininnninc are noted: /•1s a result VI the site IIIsf 0%JUVI I, II IVIIV vv ll�y uvi�v�v iv�vv .w v 1) Qualitative Monitoring Weekly visual inspections were not being recorded as required by NCG 120000, Part II, Section D, paragraph 2 (visual inspections). 2) Limitations and Controls for Stormwater Discharges a) Site is found to be in noncompliance with their erosion control permit, which is a condition of NCG120000, Part II, Section A, item 2. b) Site is found to be in noncompliance with their land fill permit by NC Division of Waste Management staff, which is a condition of NCG120000, Part II, Section A, item 3. Other Observations: Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Your written response should include a reasonable explanation as to why the aforementioned deficiencies have occurred as well as a Plan of Action to prevent these deficiencies from recurring. Thank you for your attention to this matter. This office requires that the deficiencies, as detailed above, be properly resolved. Future deficiencies could result in the issuance of a Notice of Violation which are then subject to a civil penalty assessment of up to $25,000 per day for each violation. An erosion control inspection was conducted at the same time the industrial stormwater inspection was completed along with a solid waste inspection. The site was found to be not in compliance with their erosion control permit which is a condition of their NCG120000, Part II, Section A, item 2. 2. Weekly visual inspections were not being recorded as required by NCG120000, Part II, Section D, paragraph 2 (visual inspections). 3. Site is out of compliance with their land fill permit per staff with Division of Waste Management. Compliance with land fill permit is required by NCG120000, Part II, Section A, item 3. In addition due to high waterlevel (little freeboard) in the stormwater pond, discharge is possible at the emergency spillway which requires monitoring If the waterlevel continues to rise discharge may also occur from the side of the storm water pond.
