MINIMUM CRITERIA DETERMINATION CHECKLIST

Project Location: U.S. 15-501 (Hillsboro Street) North of U.S. 64 Business to Powell
Place Lane in the Town of Pittsboro, Chatham County (see Figure 1).
Project Description: The proposed project involves the milling and resurfacing of
approximately 0.5 miles of Hillsboro Street from north of Business U.S. 64 to Launis
Street and widening approximately 1.44 miles of Hillsboro Street from Launis Street to
Powell Place Lane (just south of U.S. 64) in Chatham County. The milling/resurfacing
work will not expand beyond the existing edge of pavement and is exempt from
environmental analysis. The analysis included in this checklist is for the widening portion
of the project.
Project R-5724B is included in the 2020-2029 STIP with right-of-way acquisitions and
utility relocations scheduled for Fiscal Year (FY) 2022 and construction scheduled to
begin in the FY 2025. This project is funded in conjunction with STIP Project No. R-
5724A, a streetscape project south of R-5724B in downtown Pittsboro. R-5724A involves
the widening of existing sidewalks, reduction of vehicular travel lanes in the existing
traffic circle, resurfacing of pavement, addition of ramps, installation of curb and gutter,
and landscaping improvements. A separate checklist has been prepared for Project R-
5724A and that project is currently going through right-of-way acquisitions.
The existing section of U.S. 15-501 north of U.S. 64 is a four-lane divided roadway. The
existing undivided, two-lane typical section between U.S. 64 and Launis Street will be
widened to a three-lane roadway consisting of two travel lanes with a continuous center
turn lane. Intersections with collector roads will also be upgraded and curb and gutter will
be installed as part of the project. This roadway will be designed as a Minor Arterial with
a 40-50 mile per hour (mph) design speed. Posted speeds along the project corridor will
range from 35-45 mph. Lane widths for the proposed cross section include two 12-foot
travel lanes with a 16-foot center turn lane. In addition, a 5-foot sidewalk will be
constructed on the western side, and a 10-foot multi-use path will be constructed on the
eastern side. The Town of Pittsboro has agreed to share in the cost for the sidewalk/path
improvements and will maintain these facilities once they are constructed. The 25%
preliminary design plans and typical roadway sections are attached.
Existing right-of-way ranges from 60 feet near Launis Street to approximately 130 feet
near Old Rock Springs Cemetery Road. The roadway will be designed using the existing
grade to the greatest extent possible. Based on 25% design, approximately 2.15 acres of
additional right-of-way would be required for the proposed improvements. Acquisition of
additional right-of-way may require the displacement of two structures (a duplex located

Hillsboro Street).
The roadway will remain open during construction and a detour will not be required. The
NCDOT Project Planning Engineer will ensure that access is maintained, and impacts are
minimized during construction for properties located along the project corridor. NCDOT
will also coordinate with local schools and emergency service providers prior to
construction regarding potential temporary impacts to their services.
Purpose and Need: The primary purpose of the widening project is to improve existing
and projected traffic flow and operational efficiency on Hillsboro Street. Land uses along
the project corridor are primarily residential and commercial and multiple private
residential driveways and businesses entrances are located directly on roadway. The
corridor is classified as a north-south principal arterial that provides a direct connection
between downtown Pittsboro and U.S. 64 and serves the inter-county travel demands
between Chatham County and Orange and Durham counties. The Town of Pittsboro 2015
Comprehensive Transportation Plan (CTP) identifies the project corridor as being
“deficient” and “over capacity”. The CTP also states that “U.S. 15-501 between Pittsboro
and Chapel Hill, is the county’s most significant commuting corridor.”
Traffic Analysis
A traffic capacity study was prepared (Traffic Operations Technical Memorandum: US
15-501 Widening) by Atkins in 2017 to analyze existing and future conditions of the
roadway. Average annual daily traffic (AADT) on the project corridor in 2016 ranges
from 15,100 to 15,900 with an increase in AADT in 2040 estimated at 20,600 to 31,100.
During peak periods, turning vehicles, especially left-turning vehicles, can create backups
along the existing corridor and slow the average travel speeds. Existing operations
analysis indicates that four of the five intersections currently operate at an acceptable
level-of-service (LOS), during both the AM and PM peak hours. However, the stop‐
controlled intersection at Hillsboro Street and Old Rock Springs Cemetery Road /
Coopers Ridge Road operates with an unacceptable LOS in both the AM and PM peak
hour. This unacceptable LOS traffic condition represents significant travel delay and
increased accident potential, and inefficient motor vehicle operation. With traffic
volumes predicted to increase in the future, traffic conditions will worsen along the
corridor. Without the proposed widening project and dedicated turn lane, almost all of the
stop-controlled intersections would operate at unacceptable LOS during at least one peak
hour. The proposed project would address the need to increase capacity and enhance
mobility for vehicles by allowing for an acceptable LOS and keep the roadway
functioning properly as an arterial. The proposed project would also enhance mobility for
pedestrians and bicyclists along the corridor as they are not adequately served on the
existing roadway.

Anticipated Permit or Consultation Requirements:
Stream/Wetlands
A Natural Resources Technical Report: US 15-501 Corridor Improvement from Launis
St. to Powell Place Ln. (Atkins, 2016) was prepared to evaluate the potential impacts to
the natural environment. The majority of the project development area consists of
maintained and/or disturbed land including roadway, right-of-way, paved surfaces,
developed properties (residential and commercial), and vacant land. The report identified
a total of six (6) streams and two (2) wetlands (Table 1). The are no bridges associated
with the project; however, five (5) culverts will be replaced.
There is also an open water pond identified as P1 in the Natural Resources Technical
Report (NRTR), which is an impoundment of Stream B and connected to Wetland A, is a
part of the Robeson Creek Watershed. This watershed project was implemented
approximately 10 years ago and was funded by the Environmental Protection Agency
(EPA) 319 Grant Program. The project was designed to reduce stormwater runoff and
redistribute the overflow of Stream SB. An ATLAS screening of the project area shows
that the pond is included in the “North Carolina Effective Flood Zone” and is also
identified as a “North Carolina Department of Environmental Quality (NCDEQ) Major
Basin”.

A Preliminary Jurisdictional Determination (JD) was received on March 31, 2016. The
majority of the stream segments along the corridor are intermittent and outside of the
existing right-of-way.
In accordance with NCDOT procedures for calculating impacts to jurisdictional resources
at the preliminary planning-level design stage, preliminary designs and a 25-foot buffer
of the proposed roadway slope stakes were used to calculate impacts to water resources
located within the project study area described below.
Approximately 946 feet of streams are anticipated to be impacted by the project. Stream
impacts were calculated against the hydro design file, and the stream data layer was
created using the geometry from the Final Survey and the jurisdictional calls from the JD.

Impacts from the cut/fill lines were not calculated unless the cut/fill line directly
impacted the stream, since preference was shown to the details in the hydro design.
Approximately 0.07 acres of wetlands are anticipated to be impacted by the project.
Wetland impacts were calculated against the hydro design file, and the wetland data layer
was created using the geometry from the wetland Professional Land Surveyor (PLS)
survey and the jurisdictional calls from the JD. Impacts from the cut/fill lines were not
calculated unless the cut/fill line directly impacted the wetland.
Approximately 0.3 acres of open water are anticipated to be impacted by the project.
These impacts were calculated using the hydro design file and slope stake file.
Any impacts to jurisdictional waters resulting from the project will likely require a
Nationwide Permit (NWP) 14 for Linear Transportation Projects, assuming impacts stay
within the applicable stream and wetland impact thresholds for that permit. Coordination
will occur with NCDEQ regarding the open water impacts to pond P1 in accordance with
the 2016 Memorandum of Agreement between NCDEQ and NCDOT. A North Carolina
Department of Water Resources (NCDWR) Water Quality Certification (WQC) No. 3886
would also be required to accompany NWP 14. Project impacts will be verified, updated,
and refined at subsequent design phases. If the wetland and stream thresholds for NWP
are exceeded, the project may require an Individual Section 404 and 401 permits. The
USACE holds the final discretion as to what permit will be required to authorize project
construction and will be consulted with on final impacts and permitting requirements.
Buffer Rules
The project is located within the Jordan Lake River Basin Buffer and subject to those
rules and regulations. NCDOT will coordinate with the North Carolina Department of
Environmental Quality (NCDEQ) on compliance with implementation of the buffer rules.
Approximately 169,283 square feet (101,792 square feet for Zone 1, 67,491 square feet
for Zone 2) of riparian buffer impacts are anticipated from the project. The NCDOT will
attempt to avoid and minimize impacts to streams and wetlands to the greatest extent
practicable during project design and take the buffer rules into consideration. The riparian
buffer values represent a preliminary calculation of buffer impacts and no attempt has
been made to document regulatory exemptions based on existing land use. Additional
refinements to these values will be determined during the permitting phase of this project.
Endangered Species
As of June 17, 2021, the U.S. Fish and Wildlife Service (USFWS) lists three federally
listed protected species in Chatham County (Table 2). Habitat/field surveys and database
searches determined that the proposed project will have no effect on any federally
protected species.

In accordance with the Bald and Golden Eagle Protection Act, a desktop-GIS assessment
of the study area (as well as the area within 1.13 miles of the project limits) was
performed on June 9, 2015 using 2014 imagery. No water bodies large enough and
sufficiently open to be considered potential feeding sources were identified. Additionally,
a review of the North Carolina Natural Heritage Program (NCNHP) database (updated
April 3, 2019) indicates no known occurrences of the species within 1.13 miles of the
study area. In addition, Atkins biologists conducted field surveys in November of 2015
because of the proximity of the project to Jordan Lake and the Haw River. Due to lack of
habitat and known occurrences, it has been determined that the project will not affect this
species.
The US Fish and Wildlife Service has revised the previous programmatic biological
opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US
Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat
(NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire
NCDOT program in Divisions 1-8, including all NCDOT projects and activities.
Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 22
counties, but may potentially occur in 8 additional counties within Divisions 1-8.
NCDOT, FHWA, and USACE have agreed to two conservation measures which will
avoid/minimize mortality of NLEBs. These conservation measures only apply to the 30
current known/potential counties shown on Figure 2 of the PBO at this time. The
programmatic determination for NLEB for the NCDOT program is May Affect, Likely to
Adversely Affect. The PBO will ensure compliance with Section 7 of the Endangered
Species Act for ten years (effective through December 31, 2030) for all NCDOT projects
with a federal nexus in Divisions 1-8, which includes Chatham County, where STIP
Project R-5724 is located.
Hazardous Materials
The NCDOT GeoEnvironmental Section performed a Phase I field investigation (see
attachment) on April 2, 2018 and identified eight (8) sites of concern within the project
study area (Table 3). The anticipated risks and potential impacts to these sites from the
project is “low”.

Special Project Information:
Environmental Commitments: The list of project commitments (greensheet) is located
at the end of the checklist.
Estimated Costs: The total costs for the project included in the 2020-2029 STIP are as
follows:

Accidents: During a five-year reporting period (2011-2016), there were a total of 31 mid-
block crashes along the analyzed section of Hillsboro Street (Launis Street to Lowes
Drive/Powell Place Lane). The two most common types of crashes were rear end and
animal crashes. Rear end crashes make up more than half of the total mid-block crashes
on US 15-501 and are typically caused by slowing down due to congestion. All segments
of the roadway analyzed are below the critical crash rate and follow statewide crash
trends for its facility type.
Design Exceptions: There are no anticipated design exceptions for this project.
Hydrology: The project is in the Cape Fear River Basin and Lake Jordan Water Supply
Watershed. In order to minimize potential impacts to water resources in the project area,
NCDOT's Best Management Practices for the protection of Surface Waters will be
enforced during the construction phase of the project.
Pedestrian and Bicycle Accommodations: There are no continuous sidewalks or
bicycle facilities located on the existing project corridor. The is a short sidewalk segment
and crosswalk at Chatham Mills and Launis Street. Local area plans (Pittsboro 2009
Pedestrian Transportation Plan, Chatham County 2011 Bicycle Plan, and the Pittsboro
2014 Downtown Vision Plan) recommend the addition of bike lanes, sidewalks, and

multi-use paths along the corridor. The project includes the design and construction of a
5-foot sidewalk (western side) and 10-foot multi-use path (eastern side) as part of the
widening. The addition of these facilities would result in a positive impact to multi-modal
transportation safety along the corridor.
The Town of Pittsboro has agreed to share in the costs for the inclusion of sidewalks and
bicycle lanes with the project. In February of 2018 the Planning Director contacted
NCDOT and informed them that the Pittsboro City Council discussed the project and
asked for NCDOT to price different cross sections for the project and explore the option
for a multi-use path and spaces for landscaping improvements. Preliminary plans were
revised to accommodate this request. NCDOT is working with the Town of Pittsboro
regarding the shared costs and maintenance for these improvements and an executed
agreement will be developed prior to the contract let.
Cultural Resources: NCDOT Archaeologist provided a “No Archeology Survey
Required” form for the project on January 9, 2017 (see attachment). There is one
National Register listed Historic District (Pittsboro Historic District) within the Area of
Potential Effects. In October of 2017 the NCDOT Architectural Historian and State
Historic Preservation Office (SHPO) representative determined that the widening project
would have “No Adverse Effect” on the district. An Effects Meeting was held February
12, 2019 to review the revised project plans as the addition of the multi-use path required
additional easements at the Historic Chatham Mills property within the historic district. A
determination of “No Adverse Effects” was made at the meeting with the condition that
the project area in front of Historic Chatham Mills be designed with 2:1 slope and that
efforts be made to reduce tree takes (see attachment). Should design change and the
project extend beyond the areas assessed for historic resources, NCDOT Historic
Architecture and Landscapes Group should be contacted to determine if additional review
is necessary.
Alternatives Discussion:
No Build - The No-Build alternative would not address the need to increase capacity and
enhance mobility and would not allow for an acceptable LOS that keeps the roadway
functioning properly as an arterial.
Offsite Detour - An offsite detour was not considered because of the availability of an
acceptable onsite detour.
Agency Comments: No agency comments were submitted during the scoping process.
Local Input Forms were distributed and returned with the following comments:
Emergency Services (EMS)
A Chatham County EMS official noted that there is a lack of detour routes available in
the area and road closures or reduction in lanes could have significant impacts on
emergency service response time.

School Transportation
Chatham County Schools noted that there would be a “high” impact on school
transportation if the project corridor were closed or at reduced capacity for up to a year
due to potential detours adding “significant” time delays to the bus routes as well as
increasing the number of buses along busy US 64. They noted that 11 school buses travel
along the project corridor, with a total of 22 trips occurring per day.
Town of Pittsboro
The Planning Director for the Town of Pittsboro stated that reducing travel lanes during
construction will have a “high" impact on the town since it is the main route than runs
north/south through the area. They also noted that pedestrian and bicycle traffic use this
street and that the project will help with pedestrian/bike connectivity between the
downtown and commercial areas.
As representatives of the Chatham County Emergency Services, Chatham County
Schools, and the Town of Pittsboro stated that there could potentially be “high” impacts
from this project, these organizations will be contacted one month prior to construction to
coordinate regarding potential temporary impacts to their services.
Public Involvement: A local officials briefing and open house public meeting was held
on June 18, 2019 at Chatham Mills to present preliminary plans for the project, answer
questions, and receive comments regarding the project. A postcard advertising the
meeting was distributed to approximately 1,000 residents, property owners, and
businesses adjacent to the project corridor. A total of eight (8) local officials and 34
citizens signed in at the meeting.
NCDOT also developed a website for the project. located at: https://publicinput.com/US-
15-501-pittsboro. The NCDOT Project Website included general information on the
project, project maps/plans, and a survey to provide input on the project. Public
comments provided through the July 5, 2019 comment period included three comment
forms, three emails, and 28 individuals participated in the survey.
Overall, the public was in favor of the project (97% support for the addition of turn lanes,
93% support for the sidewalk, and 82% support for the multi-use path). Resources of
concern were primarily residences, businesses, streams, and trees. The most common
comments received are listed below:
The turn lane is too wide and should be reduced to decrease impacts
Concern for right-of-way impacts to residential properties along the roadway
Recommended minimizing tree removal
Concern over runoff/flooding

Project Description: Widen US 15-501 from Launis Street in Pittsboro to Powell Place Lane in
Chatham County. The Area of Potential Effects (A.P.E.) is approximately 2.3 kilometers (1.4
miles) long. No width is provided. The improvements include widening US 15-501 from a 2-
lane road to a 3-lane with bike lanes and sidewalks.
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
The review included an examination of a topographic map, an aerial photograph, and listings of
previously recorded sites, previous archaeological surveys, and previous environmental reviews
at the Office of State Archaeology (O.S.A.). The A.P.E. is oriented approximately north-south.
The topographic map (Pittsboro, N.C.) shows the A.P.E. crosses several ridges, side slopes, and
drainage valleys. In general, ridges, slopes and drainage valleys have a low to moderate
potential for archaeological sites. US 15-501 does not cross any major streams, but it does run
along the east side of a small, unnamed stream near the middle of the project. There are
structures scattered along both sides of the road. (The US 64 [Pittsboro] Bypass is located at the
north end of the A.P.E. although it is not shown on the topographic map.)
The aerial photograph shows the landuse in the A.P.E. is a mix of wooded and lightly-developed
areas.
A review of information at the O.S.A. shows there are no previously recorded archaeological
sites within the A.P.E. The north end of the A.P.E. has been previously surveyed for
archaeological sites as part of the US 64 (Pittsboro) Bypass project (Hargrove 1990). The survey
area for that project included several corridors. One corridor was located north of the north end
of the A.P.E., and the other crossed the A.P.E. near the north end of the A.P.E. That survey
identified several archaeological sites near the A.P.E. The sites were prehistoric lithic scatters
and late 19th/early 20th century domestic sites. None were recommended eligible for the National
Register of Historic Places (NRHP). There are several projects in the A.P.E. along US 15-501
that have been reviewed by the State Historic Preservation Office (HPO). No surveys were
recommended for any of them.

The A.P.E. for the project includes a small area along each side of the existing road. The
landforms within the A.P.E. have a low to moderate potential for archaeological sites.

continuous turn lane, curb, gutter, and sidewalks from Launis
Street to Powell Place Ln.
SUBJECT: GeoEnvironmental Planning Report
The GeoEnvironmental Section of the Geotechnical Engineering Unit performed a Phase I field
investigation on April 2, 2018 for the above referenced project to identify geoenvironmental sites
of concern. The purpose of this report is to document sites of concern within the project study
area that are or may be contaminated. These sites of concern should be included in the
environmental planning document in an effort to assist the project stakeholders in reducing or
avoiding impacts to these sites. Sites of concern may include, but are not limited to, underground
storage tank (UST) sites, dry cleaning facilities, hazardous waste sites, regulated landfills and
unregulated dumpsites.
Findings
Eight (8) sites of concern were identified within the proposed study area. We anticipate low
monetary and scheduling impacts resulting from these sites. See the following table and figure for
details.
Please note that discovery of additional sites not recorded by regulatory agencies and not
reasonably discernible during the project reconnaissance may occur. The GeoEnvironmental
Section should be notified immediately after discovery of such sites so their potential impact(s)
may be assessed.
