I've got a few follow-up requests to aid in our review. 1) The previous permit verification authorized the loss of 0.247 acre of Waters of the United States (combined stream (0.004 ac) and wetland (.243 ac) loss). In addition to the temporary/permanent stream crossing(s) requested, stream impacts are show underlying future home sites. Please clarify why mitigation for stream impacts is not proposed? A conceptual build -out exhibit with future impacts estimated would be helpful. 2) Impact locations aren't clear on the exhibits provided. It appears the temporary and permanent stream crossings would occur in the same location; please confirm. The upstream invert elevation of the temporary pipe is more than a foot higher than the upstream invert of the permanent pipe, so if these would be in the same footprint it is confusing. 3) The total stream impact of the currently proposed project, 41 linear feet (Stream Impact Table), doesn't match other information shared. Can you please confirm this is correct? i 4) The application states that the temporary crossing would be used for six to nine months and removed prior to installation of the permanent culvert. Temporary discharges cannot be placed in waters for more than six months without specific written permission from the Corps. It's conceivable that timelines or availabilities may factor into the reasoning, but can you elaborate on the need for this approach? What duration of time is anticipated between removal of the temporary pipe, and installation of the permanent one? 5) We appreciate the consideration of not burying the culvert due to slope and bedrock, but the proposal doesn't meet the condition referenced in your response to NCDWR ("Culvert burial is not required for structures less than 72-inch diameter/width, where the slope of the culvert will be greater than 2.5%, provided that all alternative options for flattening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g., rock ladders, cross vanes, sills, baffles etc). Culvert burial is not required when bedrock is present in culvert locations."). The slope is less than 2.5% and dual 66-inch culverts aren't consistent with the 72-inch threshold. If a photograph or supporting design information is available to document our approval based on bedrock it would be helpful. What considerations were made to provide for aquatic life passage? Can you please either provide a plan sheet that revises that to show culvert burial, or provide a justification for not providing burial.
